Özet

Perakendecilik sınıfı markası ile ürün sınıfı markası arasındaki ilişki birçok tar- tışmaya yol açmıştır. Nice sınıflandırılmasında, markanın kullanım amacına göre mal ve hizmetler listelenmiştir. Mallar (ürünler) üzerinde konulacak markalara ticaret markası, hiz- metlerle ilgili olarak kullanılan markalara da hizmet markası denilmektedir. Perakendecilik hizmeti, Nis sınıflandırmasının hizmetler arasında yer alan 35.05 sınıfında tasnif edilmiştir. Giacomelli kararına kadar perakendecilik hizmetlerinin bağımsız bir hizmet olma- dığı ve ürün markası sahiplerinin ürünün satışının yardımcı unsuru olduğu, bundan dola- yı perakendecilik markalarının tescil edilemeyeceği ileri sürülmekteydi. Ancak, ABAD tarafından verilen Giacomelli kararından sonra, perakendecilik hizmetlerinin ürün satışı olmadığı ve ürün markasından ayrı olarak tescil edilebileceği kabul edilmiştir. Türk doktrinine baktığımızda, halen perakendecilik hizmetinin, ürün markasına tanınan ürün satışından farklı olmadığı ve dolayısıyla ürün markası alan kişinin markasını ayrıca pe- rakendecilik hizmetleri sınıfında tescil ettirmesine gerek olmadığı görüşü ağırlıktadır. Ancak, Yargıtay kararlarına baktığımızda, ABAD kararları ve Avrupa Birliği Fikri Mül- kiyet Ofisi’nin uygulamalarının takip edildiği görülmektedir. Fikrimizce de, perakende- cilik hizmeti, ürün satışından bağımsız bir alan olup, her birisinin koruma alanı farklı olduğu için, ürün markası alan kişinin, bu marka ile mağaza açmak istemesi durumunda, bu markayı ayrıca perakendecilik hizmetleri için de tescil ettirmesi gerekir. Aksi takdir- de, mağazacılık alanında faaliyet göstermek isteyen bir kişinin marka tesciline, süresi içinde itiraz etmeyen önceki tarihli ürün markası sahibi, kendi ürün markasını mağaza ismi olarak kullanamaz. Ürün ile ürünün satıldığı perakendecilik hizmeti arasında ben- zerliğin bulunduğu kabul edilmektedir. Bundan dolayı, ürün markasının sahibi, benzer olan diğer mal ve hizmetler açısından haiz olduğu hakları, perakendecilik hizmetine karşı da haizdir. Ancak bunun ötesinde, sadece ürün markası sahibi olması, doğrudan doğruya perakendecilik sınıfında hak sahibi olduğu anlamına gelmez.

Abstract

The relationship between the retailing class brand and the product class brand has led to many discussions. In the Nice classification, goods and services are listed according to the intended use of the mark. Trademarks are intended to be placed on the goods and services. The retail service has been classified in the 35.05 class, which is among the services of the Nis classification. Until Giacomelli’s decision, it was argued that retailing services were not an independent service and that product brand owners were entiteled in selling their products, so retailing brands could not be registered. However, after Giacomelli’s decision by the European Court of Justice, it is accepted that retailing services are not product sales and may be registered separately from the product brand. When we look at the Turkish doctrine, it is still the view that retailing is not different from the sale of the product and therefore the person who takes the product brand does not need to register the brand in the category of retailing services. However, when we look at the decisions of the Turkish Supreme Court, it is seen that the decisions of ECJ and the practices of European Union Intellectual Property Office are followed. In my opinion, the retailing service is an area independent from the sale of the products, and every person intending to start a retailing business, in additon to a product manufacture and sale, should also register the brand for retailing services. Otherwise, a person who wants to operate in the field of retailing may be precduded from use of his own product brand name as a store name. It is considered that there is a similarity between the product and the retail service where the product is sold. Being a trademark owner for a specific product does not incorporate opening a store with this trade mark.
