Özet

Ruhsat almış ve piyasaya sürülebilen bir ilaç etkinliğini, güvenliğini ve kalitesini klinik araştırmalar neticesinde ispatlamıştır. Bu ruhsat ile ilaç piyasaya sunulurken ilacın endikasyonu, önerilen dozaj miktarları, kontrendikasyonları, ilaca ilişkin önemli uyarılar ve dikkat edilecek hususlar da katı bir şekilde belirlenmektedir. Hekim de ancak bu çerçevede ilacı uygulayabilecektir. Yani, endikasyonu dışında kural olarak ilacı kullanamayacaktır. Ancak hastaya uygulanacak ruhsatlı bir ilacın olmaması veya tedavinin sonuç vermemesi gibi durumlarda bir tedavi umuduyla, ilacın, ruhsatlandırılmış alanı dışında, yani endikasyon dışında hastaların yararına kullanılması mümkündür. Bunun için, hekim, ilacın endikasyonu dışında kullanılması, hasta açısından tıp standartları gereğince en uygun tedavi biçimi oluşturacağına kanaat getirmiş olması gerekir. Endikasyon dışı ilaç tedavisi, özellikle onkolojide, geriatride, pediatride olduğu gibi tedavinin endikasyona uygun bir ilacın olmaması nedeniyle diğer tıp alanlarında da sıkça uygulanmaktadır. Çalışmamızda, endikasyon dışı ilaç tedavisinin şartları ile hekimin ve ilaç üreticisinin sorumluluğu ele alınmıştır.

Abstract

A marketing authorization or product license defines a medicine's terms of use: its summary of product characteristics outlines, among other things, the indication(s), frecommended dose(s), contraindications, and special warnings and precautions for use on which the license is based, and it is in line with such use that the benefits of the medicine have been judged to outweigh the potential risks. Furthermore, a licensed medicine: has been assessed for efficacy, safety, and quality; has been manufactured to appropriate quality standards; and when placed on the market is accompanied by appropriate product information and labeling. However, there are clinical situations when the use of unlicensed medicines or use of medicines outside the terms of the license may be judged by the prescriber to be in the best interest of the patient on the basis of available evidence. In other words, an off-label use may provide the best available intervention for a patient, as well as the standard of care for a particular health problem. In oncology, pediatrics, geriatrics, obstetrics, and other practice areas, patient care could not proceed without off-label prescribing. So when scientific and medical evidence justify off-label uses, physicians promote patients' interests by prescribing products off label. This work reviews the legal aspects and the liability of prescribing of those medicine's by physician in Turkish law. We also review the role of the manufacturer of those medicine.
