Özet

Latin Amerika’da ortaya çıkan yeni anayasacılık -Antçı Anayasacılık- akımı Bolivya’yı da etkisi altına almıştır. Zorlu siyasi mücadeleler sonrasında 2009 yılında, seçimle oluşturulan kurucu meclis tarafından hazırlanan Bolivya Anayasası kabul edilmiştir. Bu çalışmada, 2009 Anayasası öncesindeki siyasi olaylar ve seçimler incelendikten sonra yeni anayasaya göre oluşturulan hükümet biçimi incelenmiştir. Yürütme ve yasama erklerinin oluşumu, yetkileri ve birbirlerine karşı konumları normatif açıdan açıklanmıştır. Bolivya Anayasasında düzenlenen başkanlık sisteminin saf başkanlık sistemi ile olan benzerlikleri ve farkları incelenerek, başkanlık sistemi konusunda bir tespit yapılmaya çalışılmıştır.

Abstract

The new constitutionalism movement that emerged in Latin America, has influenced Bolivia as well. The Bolivian Constitution was prepared by an elected constituent assembly and adopted in 2009 following a period of difficult political struggle. In this study, the political situation and elections before the 2009 Constitution and the political regime that was created by the new constitution are examined. The formation of the executive and legislative powers and positions of these powers compared each other are described with respect to a normative framework. Also the similarities and differences between the pure presidential system and the presidential system that has been adopted in the Constitution of Bolivia are examined and an attempt is made to assess the presidential system.
