Özet

Mahkemelerin dava ile daha yakın irtibata sahip ve daha uygun bir mahkemenin var olması dolayısıyla milletlerarası yetkisinden vazgeçmesi amacıyla Forum non Conveniens doktrini kabul edilmiştir. Bu doktrinin İskoç mahkemelerinin vermiş olduğu kararlarla başlayan uygulama serüveni İngiliz ve Amerikan mahkemelerinin kararları ile devam etmiş ve zamanla dönüşüme uğramıştır. İskoç mahkemeleri, ilk kararlarda kendi mahkemelerinin uygun olup olmadığı meselesinin üzerinde durmuştur. İngiliz mahkemeleri, ilk kararlarında davacının davayı açmada kötü niyetli olup olmadığını tartışmış, daha sonra bu vakayı dikkate almaktan vazgeçmiştir. Amerikan mahkemeleri ise, f orum non conveniens doktrininin kriterlerini belirlemiş ve incelememizin esasını oluşturan davada da davacının tâbiiyetine ve ikametgâhına göre “doğal” mahkemeyi belirleme eğilimini ortaya koyarak, doktrinin esnekliğine zarar vermiştir.

Abstract

Forum non conveniens is a common law legal doctrine whereby courts may refuse to take jurisdiction over matters where there is a more appropriate forum available to the parties. At earlier decisions, Scottish judiciary appears more inclined to focus on the convenience of its courts rather on the appropriateness of the alternate forum. English courts, earlier, determine the “natural forum” in which the matter should be litigated by taking into consideration the “vexation” and “oppressiveness” as prerequisites to considering a defendant’s motion to stay a proceeding. The basic criteria regarding the determination of the doctrin, that has to be construed very flexible, has put forward by American courts. On the other hand the decision that is the subject of our article did not simply preserve the flexibility inherent in the existing doctrine of forum non conveniens due to the fact that the courts analyzing the factors of the doctrin by taking into consideration the plaintiff’s citizenship and residence.
