6216 SAYILI KANUNDAKİ “TARAF OLMA” KOŞULU VE AİHS'E EK 4. VE 7. PROTOKOLLERDE YER ALAN HAKLARIN, ANAYASAL TEMEL HAKLAR OLARAK BİREYSEL BAŞVURU YOLUNDA UYGULANABİLİRLİĞİ HAKKINDA BİR DEĞERLENDİRME

Özet

2010 yılında yapılan anayasa değişikliği ile temel hak ve özgürlüklerin korunmasına ilişkin yeni bir hukuki çare olarak bireysel başvuru yolu kabul edilmiştir. Bu yeni yolun kapsamı, 1982 Anayasasının 148. maddesinde, AİHS’ye yapılan bir gönderme ile belirlenmiştir. 6216 sayılı Kanun ise, bireysel başvuru yolunu sadece AİHS’de değil, buna ek Türkiye’nin taraf olduğu protokollerde yer alan haklar açısından düzenlemiştir. Çalışmada, Anayasa ve Kanunda yer alan bu farklılığın, doktrinde yapılan tespitlerle paralel şekilde, somutlaştırmadan öte bir anayasaya aykırılık sorunu teşkil ettiği iddiası kabul edilmekle birlikte, ortada henüz bir yasal değişiklik ya da hükmü denetlemiş bir AYM incelemesi olmadığından, bireysel başvuru yolunu daraltan bu şartı daha farklı okumanın mümkün olup olmadığı sorusuna cevap aranmıştır. Bunun için, ilk olarak, Anayasada ve yasada uluslararası metinlere yapılan göndermelere, ulusal hukuk açısından yaklaşılmış, bunu ardından, AİHM ve AYM kararlarıyla 4. ve 7. Protokollerde yer alan haklara AİHS ve Anayasa tarafından genel bir koruma sağlandığı tespiti ile yasada yer alan daraltmanın aslında söz konusu protokollerde yer alan hakları ne teorik ne de uygulama açısından kapsam dışı tutmaya elverişli olmadığı sonucun ulaşılmıştır.

Abstract

The individual application has been introduced to the constitution as a new legal remedy for the protection of the fundamental rights by the constitutional amendment in 2010. Article 148 of the constitution has determined the scope of this remedy by a reference to the ECHR. The Law no.6216 has regulated this scope not only by referring to the ECHR, but also by including the additional protocols which Turkey is a party of. Faced with these two different regulations, the later considered unconstitutional by a majority of scholars, this article focuses on finding a legal solution for overcoming the problem. First of all, the possibility of providing a national interpretation to the international law references within the constitution will be discussed; and then, in the light of the decisions of Turkish Constitutional Court and the European Court of Human Rights, it will be shown that these fundamental rights and prohibitions which are regulated in the 4th and 7th Protocols are with the scope of the general protection provided by the constitution. With these findings, it shall be revealed that the regulation foreseen under Law no:6216 cannot constitute a basis for excluding the fundamentals rights covered by these protocols to from individual application procedure.
