Özet
Bu çalışmada deniz ticareti hukukunun güncel sorunlarından biri olan konteynerin beklemesinin ve gecikmesinin hukuki niteliği ile bunların taşıyan lehine doğurduğu haklar Türk hukuku esas alınarak incelenmiştir. Türk borçlar hukukuna göre, konteynerin beklemesi (“demurrage”) alacaklı temerrüdünü, konteynerin gecikmesi (“detention”) ise, borçlu temerrüdünü ortaya çıkarmaktadır. Çalışmada bu ayrıma bağlı olarak, taşıyan lehine doğan hakların niteliği de incelenmiştir. Bu bağlamda, konteynerin beklemesi sebebiyle taşıyana ödenecek bedelin esas itibariyle gerçek olmayan ceza koşulu niteliğinde olduğunu; buna karşılık, gecikme sebebiyle ödenecek bedelin ise, taşıyanın uğradığı gerçek zarar ile olan ölçüsüne göre ceza koşulu veya götürü tazminat olduğunu ortaya koymaya çalışacağız. Bütün bunların yanında konteynerin beklemesi ve gecikmesi sebebiyle taşıyan lehine doğan hakların kanuni sınırları da açıklanmış ve son olarak, İngiliz hukukunda MSC Mediterranean Shipping Co SA v. Cottonex Anstalt davasında ortaya konulan görüşler genel olarak ele alınmıştır.
Abstract
In this study, legal nature of container demurrage and detention, as one of the current issues of the maritime law, and the carrier's rights occurred as a result thereof are examined under the Turkish law. According to the Turkish obligation law, container demurrage constitutes creditor’s default (mora creditoris); on the other hand, container detention shall be considered as an obligator’s default (mora debitoris). Depending on this distinction, the legal nature of the carrier’s rights arising as consequences thereof are also examined hereinafter. In this context it is to be demonstrated that the charge to be paid to the carrier due to container demurrage is fundamentally a notional penalty clause whereas the charge to be paid due to demurrage is either a penalty clause or liquidated damage depending on the extent of the carrier's actual damage. Besides all these, limit of the carrier’s rights due to demurrage and detention of the container is also explained; and, finally, the remarks presented in the MSC Mediterranean Shipping Co SA v. Cottonex Anstalt case are discussed in general.
