Osmanlı Kıbrısı’nda Para Vakfı Uygulamaları (1750-1800)

Özet
Gelişmiş bir vakıf sistemine sahip olan Osmanlı toplumu, kendisinden önceki İslâm toplumlarında bulunmayan bir vakıf çeşidi olan para vakıflarını (vakf-ı nükûd) ortaya çıkarmıştır. 15. yüzyılın ilk çeyreğine kadar uygulama örnekleri bulunan para vakıfları, 16. yüzyılın ortalarında bir meşruiyet tartışmasına konu olsa da Şeyhulislâm Ebussuûd Efendi tarafından 1548 yılında para vakfının cevazına dair fetva ve emir çıkartılmasıyla birlikte, tekrar meşru ve resmî bir statüye kavuşmuş ve Osmanlı Devleti’nin sonuna kadar oldukça yaygın bir uygulama olarak mevcudiyetini devam ettirmiştir. Para vakıflarının Osmanlı toplumunun ekonomik kalkınmasında önemli bir rol oynadığı birçok araştırmacı tarafından ifade edilmiştir. Söz konusu vakıfların hayatiyet bulduğu yerlerden biri de 307 yıl Osmanlı hâkimiyetinde kalan Kıbrıs adasıdır. Adanın muhtelif dönemleri üzerine bazı araştırmalar vaki olsa da bu makalede ele alınacak olan 1750-1800 yılları arasında kurulan para vakıflarının nitelik ve niceliği henüz herhangi bir araştırmaya konu olmamıştır. Çalışmamız 1750 ile 1800 yılları arasını kapsayan 5 adet Kıbrıs kadı sicilinin taranması neticesinde ortaya çıkmıştır. Sözü edilen bu 5 defter, ilgili yılları kapsayan mevcut kadı sicillerinin tamamını oluşturmaktadır. Yapılan incelemede bu döneme ait 12 para vakfı kaydı tespit edilmiştir. İlgili belgeler ışığında bu dönemde para vakıflarını kimlerin ne amaçla kurduğu, bunların hangi meblağlara tekabül ettiği, vakıfların işletilmesinde herhangi bir yolsuzluğun meydana gelip gelmediği veya para vakıflarıyla ilgili hangi meselelerin mahkeme sicillerine yansıdığı gibi soruların cevabı aranmıştır.
Abstract
The Ottoman society, which had an advanced foundation system, established money foundations (vakf-ı nükûd), which is a kind of foundation and not found in the Islamic societies before. The money foundations that began to gain widespread popularity in the Ottoman society in the first quarter of the 15th century were brought to a legitimate and official status by Şeyhulislâm Ebussuûd Efendi in 1548, with the fetwa and orders issued by the monetary foundation’s authorization, existed until the end of Ottoman Empire as a very common application even though they were subject to a legitimacy in the middle of the 16th century. It has been expressed by many researchers that Money Foundations played an important role in the economic development of the Ottoman society. One of the places of the foundations mentioned is the island of Cyprus, which had been under Ottoman rule for 307 years. Although some researches on the various periods of the island have been carried out, the quality and quantity of money foundations established between 1750 and 1800, which is the focus of this paper, have not yet been subject to any research. Our work has come to the light on the reviewing of 5 Cyprus qadi records covering between 1750 and 1800. These five registers constitute the whole of the existing books covering the relevant years. In the examination conducted, records of 12 money foundations belonging to this period were identified. In the light of the relevant documents, it has been focused on the questions such as who founded the money foundations and for what purpose in this period, how much they corresponded to, whether or not any corruption occurred in the operation of the foundations, what the role of women in such foundations was, and also on the relation of the foundations with the social and economic development in the related period.
