Özet
Avrupa İnsan Hakları Sözleşmesi’nin 6. maddesinin 1. fıkrasında maddenin uygulama alanı, medeni hak ve yükümlülükler (civil rights and obligations) ve cezai alan (criminal charge) olmak üzere iki soyut kavram ile ifade edilmektedir. Bu soyut kavramlar Avrupa İnsan Hakları Mahkemesi kararlarıyla somutlaştırılmaktadır. Ancak Mahkeme kararlarında, söz konusu kavramları otonom bir şekilde ele alınmaktadır. Bu bakımdan söz konusu kavramların kapsamının doğru bir şekilde saptanması hem Mahkeme açısından hem de başvuranlar açısından önem arz etmektedir. Bu çalışmanın ilk bölümünde bir insan hakkı olarak adil yargılanma hakkının önemi üzerinde durulmuştur. İkinci bölümünde ise adil yargılanma hakkının uygulama alanını oluşturan medeni hak ve yükümlülük kavramı kapsamında görülen hak ve yükümlülükler ile cezai alan kapsamında görülen isnatlar Avrupa İnsan Hakları Mahkemesi kararları esas alınarak incelenmiştir.
Abstract
Scope of application of the right to fair trial is civil rights and obligations and criminal charge as an abstraction concepts which is put into words within the framework of the sub-article 1 of article 6 of the European Convention on Human Rights. These abstraction concepts become concrete within decision of European Court of Human Rights. However these relevant concepts are approached as an autonomous concepts in the Court’s decision. In this regard to determine these concepts’ exact scope have a great importance in the application for both the ones who apply the European Court of Human Rights and the European Court of Human Rights which adjudicates the applications done. In this study, first, there is an examination of importance in the right to fair trial as an human rights. At the second part of study, based on jurisprudence of the European Court of Human Rights, what is civil rights and obligations and criminal charge that constitute the scope of application of the right to fair trial are examined.
