THE ACT OF THE SOLICITATION TO THE OFFENCE IN CRIMINAL LAW: THE ORIENTATION TO THE OFFENSE

Özet

Türk Ceza Kanunu (TCK)’nda “Suça İştirak” kapsamında düzenlenen azmettirme başlıklı hükümde suça azmettiren kişinin işlenen suçun cezası ile cezalandırılacağı belirtilmiştir. Azmettirmenin tanımı ise madde gerekçesinde yapılmıştır. Buna göre azmettirme, belli bir suçu işleme hususunda henüz bir fikri olmayan bir kişide başkası tarafından bu suçu işlemeye karar verdirilmesidir. Bu açık tanıma rağmen bazı durumların azmettirme hareketi olup olmayacağına karar vermek kolay değildir. Nitekim ev sahibinden habersiz kapıda bekleyen hırsızı gören ev sahibi, sigorta şirketinden para almak amacıyla hırsızın evine girmesi için kapıyı açık bırakır ve evden ayrılırsa ev sahibinin bu hareketinin azmettirme hareketinin olup olmayacağı, önemli tartışma konularından biridir. Bu sorunun çözümü için Alman hukukunda farklı teoriler geliştirilmiştir. Bu bakımdan bu makalede bu teoriler dikkate alınarak azmettirme hareketi kapsamlı bir şekilde irdelenmektedir. Elbette bu inceleme yapılırken Alman hukukundan da yararlanılmaktadır.

Abstract

In the Turkish Criminal Code, in the provision regulated under the heading of the solicitation, it is stated that a person soliciting another person to commit offence is punished according to the degree of crime committed. The solicitation is defined in the law’s preamble. Accordingly, the solicitation is that a person gets another person who has no intend to commit a crime to make a decision to commit this crime. Despite the clear definiton, it is not easy to determine whether or not some acts will create the solicitation. As a matter of fact, if the householder, who sees a thief waiting in front of the door and is unaware of the householder, leaves the door open and leaves the house with the intent of getting money from the insurance firm, whether or not this act of the householder constitutes the act of the solicitation will be important question of debate. Different theories have been developed in German law to solve this problem. In this respect in this article, the act of solicitation is examined in detail by considering these theories. Of course, while this examination is made, German law is also considered.
