Anayasa uzlaşma komisyonu: Toplum sözleşmesi için bir fırsat

Özet

30 yıldır yürürlükte olan anayasamız, mimarları, içeriği ve ruhu bakımından toplumsal sözleşme niteliği taşımamaktadır. Mevcut anaya- sanın kaldırılması noktasında ortak irade mevcut olmasına rağmen, si- yaset geleceği kurmak yerine konjonktürü kurtarma felsefesini tercih etmiştir. Bu yüzden milletin gerisinde kalmıştır. Ancak bugün yeni ana- yasa noktasında bir oydaşma mevcuttur. Uzlaşma komisyonu üyeleri olarak toplum sözleşmesi oluşturma şansını yitirmemek gerektiği bilinci ve sorum- luluğu içerisindeyiz. Yeni anayasanın mimarı ve referans kaynağı millet ola- caktır. Bu bağlamda millet iradesini doğru analiz etmeyi amaçlıyor denge ve fren mekanizması güçlü bir sistem modelini arzuluyoruz.

Abstract

The current constitution which has been in force for 30 years does not have a character of a social contract in the terms of its architects, content and spirit. Although, there has been a common will at the point of changing the current constitution, politics had preferred to save the day instead of building the future. Therefore, the politics has been behind the people. However, there is a consensus on a new constitution. As the members of the Constitutional Reconciliation Commission, we are aware of the need of seizing the chance to create a social contract, and this is our responsibility. Architects and the reference source of the new constitution will be people of Turkey. In that respect, we aim to analyze correctly national will and want to establish a system, which has a strong checks and balance mechanism.
