Özet

Türkiye beş yıldan beri yeni bir anayasa, sivil bir anayasa, arayışı içerisindedir; zira 1982’de kabul edilmiş olan mevcut Anayasa gerçek anlamda demokratik olmadığı gibi aradan geçen zaman zarfında ger- çekleştirilen on sekiz anayasa değişikliği de demokratik bir anayasal düzenin kurulması için yetersiz kalmıştır. Ancak bu arayış bugüne kadar (Haziran 2013) başarısızlıkla sonuçlanmıştır. Bunun arkasında Ana- yasa’nın ilk maddelerinin değiştirilemez nitelikte olması gibi hukuki nedenler yatmaktadır. Buna karşın söz konusu başarısızlığın esas nedeni siyasetçiler arasında gerçek bir uzlaşmanın bulunmamasıdır.

Abstract

RESUME La Turquie cherche à adopter une nouvelle constitution, une "constitution civile", depuis cinq ans, car le texte actuel qui date de 1982 n'est pas réellement démocratique, et les 18 amendements qui ont été adoptés depuis sont insuffisants pour instaurer un ordre constitutionnel démocratique. Mais jusqu'aujourd'hui (juin 2003), c'est un échec. Il y a des raisons juridiques qui l'expliquent, ainsi le caractère inaltérable des premiers articles de la Charte; mais l'absence d'un réel consensus au sein de la classe politique est la principale raison de cet échec. ABSTRACT Turkey has been in search of a new and “civil” constitution for five years because the current constitution, adopted in 1982, is not truly democratic in the real sense. Also, eighteen constitutional amendments carried out in the elapsed time were not sufficient for the establishment of a democratic constitutional order. However, so far (June 2013) this search was unsuccessful. Although there are legal explanations for the failure (like the first articles of the constitution), but the absence of a real consensus in the political class is the main reason for the failure.
