Özet
2001 yılı Anayasa değişiklikleri ile 13. maddede yer alan genel sı- nırlama sebeplerinin kaldırılması genel olarak bir reform niteliğinde gö- rülmüştür. Bununla birlikte her madde için özel sınırlama sebepleri ti- tizlikle ele alınmamıştır ve pek çok temel hakka ilişkin maddede özel sınırlama sebebi/sebepleri bulunmamaktadır. Bu durum bir dizi sorunu beraberinde getirmiştir. Anayasa Mahkemesinin, temel hakların özel sınırlama sebepleri bulunmaması konusundaki kararları kural alarak hem sınırlama sebebi hem de yasa kaydı bulunmayan temel haklara ilişkindir. Çalışmamızda bu temel hakların yasa koyucu tarafından sınırlandırılıp sınırlandırıla- mayacağına ilişkin doktrindeki görüşler ile Anayasa Mahkemesi karar- ları ele alınmış; bu bağlamda Anayasa Mahkemesi kararlarına ilişkin değerlendirmeler ile çözüm önerilerine yer verilmiştir.
Abstract
The abolition of the general limitation grounds laid down in Article 13 of the Constitution by the 2001 Amendments was generally considered a reform; however, the specific limitation grounds for every fundamental right were not handled meticulously. In numerous articles of the Constitution relating to fundamental rights, there are no limitation grounds. This situation has given way to a number of problems. The Constitutional Court’s decisions on the fundamental rights with no limitation grounds are in principle about the rights which are not subject to statutory reservation and which have no limitation grounds. In this study, we have reviewed the opinions of the scholars regarding whether or not the fundamental rights in this category should be restricted by the legislator as well as the decisions of the Constitutional Court. In the present study, an evaluation of the Constitutional Court’s decisions and proposals for the solution to the related problems have been presented.
