Özet
Kadının kendi soyadını kullanması ve bireyin etnik kökenine da- yanan isimler alması karşısında Türk Anayasa Mahkemesi güçlü bir di- renç göstermektedir. Anayasa şikayeti yolu ile kadının soyadına ilişkin sorun bir ölçüde aşılmıştır. Burada da kararın etkisi tartışması başlaya- caktır. Aksi yönde İHAM kararlarına rağmen hem anayasa yargısı ala- nında, hem de yasama organının sessizliği anlamında son üç yıllık bi- lanço negatiftedir.
Abstract
Turkish Constitutional Court opposes a rigorous resistance against women would like to use her own surname and individuals want to use name based on their ethnic origin. The problem related to the woman's last name has been surpassed in a certain extent through constitutional complaint way. Now the discussion of the impact of the decisions would be another problem. Although the ECHR decision is contrary, in the field of constitutional jurisdiction as well as policy of inaction of the legislature, the consequences of the problem in this field are negative for last three years.
