Özet

Türkiye’de 2010 yılında yapılan Anayasa Değişiklikleriyle Anayasa Mahkemesine bireysel başvuru hakkı tanınmış, daha sonra çıkarılan 6216 sayılı Kanun ve Anayasa Mahkemesi İçtüzüğünde ise bireysel başvuru hakkının kötüye kullanılması yasağı hakkında düzenlemeler getirilmiştir. Anayasa Mahkemesi de çok sayıda bireysel başvuruyu hakkın kötüye kullanılması niteliğinde görmüş ve söz konusu hükümler kapsamında kararlar vermiştir. Çalışmada Anayasa Mahkemesinin bireysel başvuru hakkının kötüye kullanılması yasağı konusundaki yaklaşımı, özellikle Mahkemenin hangi davranışları hakkın kötüye kullanılması niteliğinde saydığı, bu çerçevede hangi muhataplar hakkında ne tür yaptırımlar uyguladığı incelenmiş ve ilgili kararları temel hak ve özgürlüklerin korunması konusunda önem taşıyan çeşitli anayasal ilkeler açısından değerlendirilmiştir.

Abstract

In Turkey, the right to individual application was recognized by Constitutional Amendments made in 2010; in the later issued Law no. 6216, and the Rules of Procedure of the Constitutional Court, regulations about the abuse of the right to individual application were introduced. The Constitutional Court has regarded a large number of applications as abusive within the scope of such provisions and made decisions accordingly. In this article the approach of the Constitutional Court to the prohibition of the abuse of individual application, in particular what kind of behaviors are regarded as abusive by the Court, and in this context, what kind of sanctions are imposed on the respondents by the Court are examined, and the decisions of the Court on this subject are evaluated in terms of the various constitutional principles on protection of fundamental rights and freedoms.
