Özet

Ayıp, genel olarak tüketicinin sözleşme gereği maldan beklediği yararı elde edememesi ya da objektif olarak maldan beklenmesi gereken yararın elde edilememesi ya da vaad edilen niteliklerin bulunamaması halidir. Tüketici ayıplı malı edindiğinde sözleşmeye aykırı ifanın yanında malın kullanılmasına bağlı zararları da doğabilir. Bedensel bütünlük ihlali de tüketicinin ayıplı malı kullanması nedeniyle ortaya çıkması muhtemel zararlardandır. Ayıplı ifa nedeniyle bedensel bütünlük ihlali sadece tüketicide değil; onun yakınlarında da meydana gelebilir. Bedensel bütünlük ihlaline bağlı olarak da tüketicinin ve yakınlarının birbirlerinden bağımsız olarak yaşadıkları sıkıntı nedeniyle manevi zararları doğabilir. Tüketici, satış sözleşmesine göre manevi zararının giderilmesini talep edebilirken; tüketici işlemi niteliğinde olan satış sözleşmesine yabancı olan üçüncü kişi konumundaki tüketicinin yakınları, manevi zararlarının giderilmesini üçüncü kişiyi koruyucu etkili sözleşme kapsamında talep edebilirler. Ayrıca tüketici ile yakınlarının ürün sorumluluğu kapsamında güvenli olmayan ürün nedeniyle de bedensel bütünlük ihlallerine bağlı olarak manevi zararları doğabilir. Güvenli olmayan ürün, piyasaya sürüldüğünde tüketicinin haklı güvenlik beklentisini karşılamayan üründür. Tüketicinin ve üçüncü kişilerin üreticiden talep edecekleri manevi zararlarının hukuki dayanağı tartışmalıdır. Çünkü üreticinin sorumluluğunun hukuki dayanağı tartışmalıdır ve üretici ile tüketici ya da üçüncü kişi arasında sözleşme ilişkisi yoktur.

Abstract

Defect is in general described as the case where the consumer cannot have the expected benefit from the good pursuant to the contract or cannot have the benefit which is objectively expected from the good or where the good does not possess the promised qualities. In case of acquisition of a defectivegood, in addition to the breach of the contract, the consumer may incur damages resulting from the use of such good. Personal injury is a possible item of damage that may incur in case of the use of a defective good. Personal injury due to use of non-comforming product may occur not only on the side of consumer, but also at the side of his/her legal dependants. Accordingly, both the consumer and legal dependant, independant of each other, may suffer non-pecuniary damage due to personal injury. The consumer may claim compensation based on the consumer contract; whereas, the legal dependant of the consumer who are foreign to the contract relationship may claim compensation based on the theory of contract with the effect of third party protection. Also, non-pecuniary damage of the consumer and his/her legal dependants may ocur under product liability due to the use of unsafe product. Unsafe product is defined as product that fails to meet with the security expectations of the consumer at the time of placing on the market. The legal ground of the non-pecuniary compensation of the consumer and his/her legal dependants is debated. This debate results from the debate with respect to the legal ground of producer’s liability and a contract relationship between the consumer and his/her legal dependants is non-existent.
