Özet

1982 Anayasası örneğinde görüldüğü gibi, cumhurbaşkanının sorumluluk rejiminin bütünüyle ve açıkça öngörülmüş bulunmadığı anayasal düzenlerde cumhurbaşkanının sorumluluğu konusunda özellik arz eden husus, sorumluluğu taşıyan öznenin kimliği itibariyle siyasi sorumluluk ile cezai sorumluluğun iç içe geçmiş olma ihtimalidir. Bu durumda, anayasal boşlukların ve/veya anayasal düzenlemelerde yer alan muğlak kavramların cezai sorumluluğun siyasi sorumluluktan ayırt edilmesini güçleştirmesi ve mevzubahis durumun cumhurbaşkanının sorumsuzluğu paradoksuna yol açması mümkündür. Halbuki, demokrasi ile idare olunan cumhuri rejimlerde, kimsenin sahip olduğu makam itibarıyla kanunların üzerinde bir yer işgal etmesi mümkün olmadığı gibi, icrai tesir doğurabilecek nitelikte yetkilerle donatılmış bulunanların da bu yetkilerin kullanımından dolayı sorumsuz olmaları kabul edilemez. Bu itibarla, muasır demokrasilerde, kamu yetkilerini kullananlar ile kamu arasındaki rabıta yetki sahiplerinin sorumluluk rejimleri üzerinden tesis edilmektedir.

Abstract

As is seen in the under 1982 Turkish Constitution, in a constitutional order in which the liability regime of the president of the republic has not been established in extenso and clearly, the main question about the liability of the president of republic is the probability of intertwinement of criminal liability with political liability. In this case, it is possible for the constitutional gap and/or obscure conceptions in constitutional provisions, to complicate the differentiation of the criminal liability from political liability and for the situation in question to cause an irresponsibility paradox of the president of the republic. Whereas in republicain regimes governed by democracy it is impossible for anyone to occupy a place beyond the laws in respect of his/her position, it is also unacceptable for those furnished with authority to avoid responsibility for his/her exercise of such authority. In this respect, the relationship between authority and the public has been established upon the liability regimes of the authority-possessors.
