Özet

Resmî belgeyi bozmak, yok etmek veya gizlemek suçu, TCK’nun 205. maddesinde düzenlenen topluma karşı suçlar içerisinde kamunun güveni aleyhine işlenen bir suçtur. Seçimlik hareketli bir suç olan resmî belgeyi bozmak, yok etmek veya gizlemek, sırf hareket suçudur. Hareketlerden biri ya da hepsi gerçekleştirildiğinde suç tamamlanır. Özgü suç niteliği bulunmayan bu suçta fail herkes olabilir. Suçun kamu görevlisi tarafından işlenmesi ağırlaştırıcı sebep olarak düzenlenmiştir. Yargıtay uygulamasında da tartışılan bu suç tipinin manevi unsuru genel kasttır.

Abstract

Altering, destroying or hiding a -n official document is an offence under article 205 of the Turkish Penal Code, in the section on crimes against society, committed agains public trust. Altering, destroying or hiding an official document is an offence of voluntary action. It is committed upon completion of the action or actions. Anyone can be the perpetrator of this offence. Committing of the offence by a public officer is a an alleviating factor. General intent is the subjective element of this offence, which is debated in Court of Appeal precedent.
