Özet

Bu yazının amacı insanın özgürlüğünü elde etmesi/elinde bulundurması -bir kimsenin bir diğerinin tahakkümü altında olmaması- sürecinde merkezi bir araç olarak konumlanan özel mülkiyetin açığa çıkışı, meşruiyeti sorununu Locke ve Rousseau’nun kuramları bağlamında ele almaktır. Çalışma bu iki yaklaşım bağlamında yapılacak karşılaştırma doğrultusunda, özel mülkiyete ilişkin olarak verilmiş tasarımlardan hangisinin özgürlüğü sağlamada daha yetkin olduğunu sorgulamaya çalışacaktır. Sonuçta özel mülkiyet moral ve normatif bağlamlarda özgürlüğün asıl kurucusu olarak Locke’ta olduğu gibi ihlal edilemez bir hak olarak konumlandırılacaktır

Abstract

The purpose of this paper is to deal with the emergence of private property and its legitimacy as a central tool in the process of achieving/securing freedom of man -that no one is under the domination of one another- in the context of the theories provided by Locke and Rousseau. This study will try to question which of the given designs in relation to private property is more competent in terms of freedom in the context of these two approaches by comparisons method. As a result, private property will be positioned as an inviolable right as in Locke as the master promoter of freedom both in moral and normative contexts
