İmam Mâlik’in Hadisçiliği ve Re'yciliği Konusunda Bir İnceleme

Özet
Bu araştırma, Maliki mezhebinin kurucu imamı Mâlik b. Enes'in mensubiyet bakımından hadis ekolü ile re'y ekolü arasındaki konumunu incelemektedir. Medineli İmam Mâlik, genel olarak Hicaz hadis ekolüne mensup kabul edilmekle birlikte, içtihat yönteminde re'y merkezli delillerin kullanımına da önem verdiği bilinmektedir. Bu hususu, İmam Mâlik'ten tevarüs ettiğimiz el-Muvatta adlı eserinin de doğruladığını söyleyebiliriz. Fıkıh mezhepleri ve mensupları üzerine araştırma yapan araştırmacılar farklı öncüllerden hareketle gerek mezhepleri ve gerekse mezhep bilginlerini temel iki yöneliş olan ehl-i hadis ve ehl-i re'y ekolünden birisine mensup kılma çabasını göstermişlerdir. Araştırmamızda, Mâlik b. Enes'in fıkhî uygulamaları ve bu uygulamaların tespitinde etkin rol oynayan fıkıh usûlü yaklaşımları değerlendirilerek, onun hadis ve re'y ekolleri arasındaki konumu belirlenmeye çalışılmıştır. Mâlik b. Enes, fıkhi çözümlemelerde rivayetlere yer verse de bazı durumlarda Medine ehli amelini tercih edip öncelemesi, kıyas, istihsan ve istislah gibi re'y ağırlıklı yöntemleri kullanması, onu re'y ekolüne yakın kılan hususlar olarak görülebilir. Mezhep imamlarını ve mensuplarını bir ekole mensup görmenin elbette o mezhebin fıkhi görüşlerine yansımaları olmaktadır. Sonuç olarak, araştırma, İmam Mâlik'in hem hadis ehli hem de re'y ehli özellikleri taşıdığını ve bu nedenle onun bu iki ekolden sadece birine mensup kılınarak hakkında kesin bir sınıflandırmada bulunmanın güç olduğunu vurgulamaktadır.
Abstract
This study examines the position of Mālik b. Anas, the founding imām of the Mālikī school, in terms of his affiliation between the ḥadīth-oriented and raʾy-oriented schools. Although the Medinan scholar Imām Mālik is generally regarded as belonging to the Ḥijāzī ḥadīth school, it is well established that he also attached importance to the use of raʾy-based evidences in his juristic methodology. This point is corroborated by his transmitted work al-Muwaṭṭaʾ. Researchers investigating the Islamic legal schools and their adherents, starting from various premises, have often sought to classify both the schools and their leading figures as belonging to one of the two main orientations: the ahl al-ḥadīth or the ahl al-raʾy. In this study, the legal practices of Mālik b. Anas, together with the methodological approaches of uṣūl al-fiqh that played a decisive role in shaping these practices, are analyzed in order to determine his position between the ḥadīth and raʾy schools. Although Mālik b. Anas incorporated transmitted reports into his legal reasoning, his preference in certain cases for the practice of the people of Medina, as well as his employment of raʾy-oriented methods such as qiyās, istiḥsān, and istiṣlāḥ, can be viewed as aspects drawing him closer to the raʾy school. Classifying legal school founders and adherents under a single school inevitably has implications for the interpretation of that school’s legal positions. In conclusion, this study underscores that Imām Mālik embodies characteristics of both the ahl al-ḥadīth and the ahl al-raʾy, and thus, any definitive classification that affiliates him exclusively with one of these two schools proves to be problematic.
