Abstract
There are various opinions regarding the legal characteristics of the legal relationship between the private hospital and the patient, both in the doctrine and Supreme Court practises. This study examines the views in the doctrine on what the legal relationship between the parties will be and which statutory provisions will be applied in the case of outpatient treatment and inpatient treatment individually.

Özel hastane ile hasta arasındaki ilişkinin hukuki niteliğine ilişkin gerek öğretide gerekse Yargıtay içtihatlarında konu ile ilgili farklı görüşler bulunmaktadır. Bu çalışma hastanın özel hastanede ayakta tedavi olması durumu ile yatarak tedavi olması durumlarında taraflar arasındaki hukuki ilişkinin ne olacağı ve hangi hükümlerin uygulanacağı konusunda öğretide yer alan görüşleri incelemektedir
