Abstract
Software is protected as a work according to the Law of Intellectual and Artistic Works. In this context, the financial and moral rights on the work belong to the author. The only way for the software to be put on the second hand market in accordance with the law without the permission of the author is to fulfill the conditions of the exhaustion principle. In the study, the conditions necessary for the evaluation of the software within the scope of the exhaustion principle have been tried to be examined in detail by considering the various possibilities that the software is inherited from the application.

Yazılımlar FSEK m. 2 çerçevesinde eser olarak korunmaktadır. Bu çerçevede, eser üzerindeki mali ve manevi haklar eser sahibine aittir. Eser sahibinin izni olmadan yazılımın hukuka uygun bir şekilde ikinci el olarak piyasaya sürülebilmesinin tek yolu tükenme ilkesinin şartlarının gerçekleşmesidir. Çalışmada yazılımların tükenme ilkesi kapsamında değerlendirilmesi için bulunması gereken şartlar uygulamada yazılımların devralındığı çeşitli ihtimaller göz önünde bulundurularak ayrıntılı olarak incelenmeye çalışılmıştır.
