THE COLLECTIVE AGREEMENT COVERAGE RATIO IN EUROPE AND OUR COUNTRY AND THE FACTORS AFFECTING THIS RATIO

Abstract
The collective agreement coverage ratio is the ratio of the workers whose working conditions are regulated by one or more collective bargaining agreements to other workers. In terms of the development of collective bargaining autonomy, the coverage ratio of the collective bargaining should be high. In collective labor law, the union density is very important. However, the number of unionized workers does not indicate the number of workers covered by the collective agreement alone. Because being a union member is not a definite data that reveals that a worker benefits from a collective agreement. The legal regulations regarding the collective labor law applied in a country and the preferences of the legislator in this context determine the coverage rate of the collective agreement. In our study, the subject is examined by making explanations about our country and different countries and the historical process is also included.
Özet
Toplu iş sözleşmesi kapsama oranı, çalışma koşulları bir ya da birden fazla toplu iş sözleşmesi ile düzenlenen işçilerin, diğer işçilere olan oranıdır. Toplu iş sözleşmesi özerkliğinin gelişmesi açısından toplu iş sözleşmesi kapsama oranının yüksek olması gerekir. Toplu iş hukukunda sendikal yoğunluk oldukça önemlidir. Ancak sendikalı işçi sayısı, tek başına toplu iş sözleşmesi kapsamında olan işçi sayısını göstermez. Zira sendika üyesi olmak, bir işçinin toplu iş sözleşmesinden yararlandığını ortaya koyan kesin bir veri değildir. Bir ülkede uygulanan toplu iş hukukuna dair yasal düzenlemeler, bu kapsamda kanun koyucunun tercihleri, toplu iş sözleşmesi kapsama oranını belirlemektedir. Çalışmamızda tarihsel sürece de yer verilmiş, ülkemiz ve farklı ülkeler hakkında açıklamalar yapılmak sureti ile konu incelenmiştir.
