Şartü’l-izni’l-âm li salâti’l-cumua’

Özet

Diğer bütün ibadetlerde olduğu gibi Cuma namazının da farz olması ve eda edilmesi için şartları vardır. Bu şartların bazıları hakkında icmâ edilmiş bazılarında ise ihtilaf edilmiştir. Bu makalede üzerinde ihtilaf edilen şartlardan birisi olan “izn-i âm” yani devlet başkanının Cuma namazının kılınması için izin verdiği mescidin toplumun tamamına açık olması gerektiği sadece belli bir sınıf ya da zümreye özel bir mekan olmaması meselesinde alimlerin ve dört mezhebin görüşleri ile bu şartın illeti konusunda bir kanaat oluşturulmaya çalışılacaktır. Böylece bu genel izin konusundaki yanlış kanaat ve anlaşılmaların sebepleri ile günlük hayattaki etkisine işaret edilecektir. Bu arada farklı görüşlere cevaplar verilmeye ve farklı görüşlere sahip alimler arasındaki ihtilaf noktalarına temas edilmeye gayret edilecektir. Bütün bu izahlar yapılırken tümevarım ve tümdengelim metotlarına dayanılarak dört mezhebe göre Cuma namazının şartları ile “izn-i âmm” yani genel izin konusunda dört mezhebe göre gerekli olan şartlar ayrıntılı olarak ele alınmaya çalışılmıştır. Böylece genel izni şart koşanlara göre bu şartın uygulanmasının en önemli sonuçları ile âlimler arasındaki ittifak ve ihtilaf noktaları konusunda bir sonuca ulaşılmaya çalışılmıştır.

Abstract

As with all other acts of worship there are rules for Friday prayer to be fard and to be performed. Some of these conditions have been agreed on while some have been disputed. In this article, the opinions of scholars and four sects on the issue of "izn-i am" that is the mosque allowed by the head of state to perform the Friday prayer should be open to the whole society and that it is not a special place for a certain class or group is discussed. It tries to form an opinion about the cause of the condition. Thu، the causes of misunderstandings and the significant misunderstandings about this general permission and its effects on daily life are pointed out. Meanwhile, it gives answers to different views and covers the points of disagreement between scholars with different views. While making all these explanations based on the inductive and deductive methodsthe conditions of the Friday prayer according to the four sects and the conditions necessary for the "izn-i am” that is the general leave according to the four sects were discussed in detail. Thus it gives a conclusion about the most important results of the application of this condition and the points of alliance and disagreement among the scholars according to those who stipulate the general consent.
