The evolution of unemployment insurance in Turkey

Abstract

ILO has accepted the Social Security (Minimum Standards) Convention in 1952. Convention No.102 as the fundamental social security Convention embodies an internationally accepted definition of the very principle of social security. According to the Convention 102, part IV,”Each Member for which this Part of this Convention is in force shall secure to the persons protected the provision of unemployment benefit in accordance with the following Articles of this Part”. In Turkey, unemployment insurance based on mandatory attendance and insurance technique was established as a branch of the social security system by the state with the Law of Unemployment Insurance, the law no. 4447, in 1999. According to the Law, the insurance is based on the compulsory contributions of employer, employee and the state. Unemployment benefits are paid to insured workers, who lost their jobs against their will. This paper investigates the evolution of unemployment insurance and unemployment insurance programme is analyzed in the context of its coverage and the benefits it provides.

ILO, 1952'de Sosyal Güvenlik (Minimum Standartlar) Sözleşmesini kabul etmiştir. Temel sosyal güvenlik sözleşmesi olan 102 sayılı Sözleşme, sosyal güvenlik ilkesinin uluslararası kabul görmüş bir tanımını içermektedir. 102 sayılı Sözleşmenin IV. Bölümüne göre, " Sözleşmenin bu bölümünü yürürlüğe koyan her Üye, korunan kimselere, bu bölümün izleyen maddelerine uygun olarak işsizlik yardımları yapılmasını teminat altına almalıdır”. Türkiye’de zorunlu katılıma ve sigorta tekniğine dayalı işsizlik sigortası sosyal güvenlik sisteminin bir dalı olarak devlet tarafından 1999 yılında çıkarılan 4447 sayılı İşsizlik Sigortası Kanunu ile kurulmuştur. 4447 sayılı Kanuna göre işsizlik sigortası; işçi, işveren ve devletin zorunlu katkılarına dayanır ve işsizlik sigortası yardımları bir işyerinde çalışırken, kendi isteği dışında işini kaybeden sigortalı işçilere ödenir. Bu çalışmada Türkiye’de işsizlik sigortasının gelişimi incelenerek, mevcut durum değerlendirilecektir.
