Özet
Dava, Stephan Thaler tarafından geliştirilmiş olan, üzerinde çalıştığı konuyla ilgili sorunları hiçbir insan müdahalesi olmaksızın kendi kendine tespit ederek yeni çözümler getirebilen, DABUS isimli yapay zeka teknolojisi ile çalışan sistemin ortaya koyduğu buluşların patentlenmesine ilişkindir. Avustralya Patent Kurumu’nun yapay zeka teknolojisi ile çalışan sistemler, yasal kişiliğe sahip olmadıkları gerekçesiyle geliştiricinin başvurusunu reddetmesi üzerine geliştirici Avustralya Federal Mahkemesi’ne başvurmuştur. Mahkeme patent kurumunun red kararını iptal etmiş ve sözkonusu patent başvurusunda buluşçusu olarak DABUS’un kaydedilmesine hükmetmiştir. Bu çalışmada da öncelikle sözkonusu karar incelenecek, ardından yapay zeka teknolojilerinin ortaya koyduğu buluşların patentlenmesine ilişkin uluslararası hukukta verilmiş kararlar incelenecek ve ardından Türk Patent ve Marka Kurumu’na benzer bir başvurunun yapılması ihtimalinde verilmesi olası karara değinilecektir.
Abstract
The case is about the patenting of an invention by an AI based system called DABUS, which can detect the problems related to the subject it is working on by itself and bring new solutions without any human intervention. The developer, Mr. Stephan Thaler, applied to the Federal Court of Australia after the Australian Patent Institute rejected the application for the reason that AI based systems do not have legal personhood. The court annulled the decision of the patent institution and ruled that DABUS should be registered as the inventor in the patent application. In this study, the Federal Court of Australia’s decision will be examined, then the decisions in international law regarding the patenting of inventions revealed by artificial intelligence technologies will be examined and then the possible decision to be given in case of a similar application to the Turkish Patent and Trademark Off ice will be mentioned.
