Public Service and Secularism: Reflections on a Decision of the French Council of State

Özet

Fransız tipi lâiklik, gittikçe artan ve sosyal hayata dâhil olan Müslüman nüfus sebebiyle, sık sık hukukî sorunlara yol açmaktadır. Kamuoyu tepkilerine karşı daha hassas olan yasama organı ve onu takip eden Anayasa Konseyi, zaman içerisinde daha katı bir lâiklik anlayışına meyletmektedir. Dinî inançların ifade edilmesi ve kamu hizmetlerinin sunumunda dikkate alınması hususunda nispeten hürriyetçi bir yaklaşım sergileyen Fransız Danıştayı (Conseil d’État) ise, içtihadını Anayasa Konseyi’nin yeni yorumuyla telif etmeye çalışmaktadır. Bu makalede; kamuya ait okullarda domuz içerikli yemeklere alternatif sunulmasından ibaret bulunan ikame menü uygulamasının lâiklik ve kamu hizmetlerinde tarafsızlık ilkeleri bağlamında değerlendirildiği yakın tarihli bir karar, söz konusu bağdaştırma çabası açısından incelenmektedir.

Abstract

The principle of laïcité (secularism à la française) frequently causes legal problems due to the increasing Muslim population that is getting involved in social life. The legislature, which is more sensitive to public reactions, and the Constitutional Council following it, tend to a more rigid understanding of laïcité over time. The French Council of State (Conseil d’État), which has been showing a relatively liberal approach towards the expression of religious beliefs and consideration of them in the provision of public services, is trying to reconcile its case-law with the new interpretation of the Constitutional Council. In this article; a recent decision in which the substitute menu practice that consists of off ering an alternative to porkcontaining meals in public schools is evaluated in the context of the principles of laïcité and neutrality (impartiality) in public services, is examined in terms of the said reconciliation eff ort.
