The Condition of the Jurists in the Almoravid Dynasty

Abstract
The Almoravid dynasty, which conquered the region of Andalusia in North Africa, reigned between the years 448-543 (1056-1147). The foundation of the Almoravid dynasty was laid by Mâliki scholar Abdullah b. Yasin, who established a small fortification for the act of showing the true path and communication among the tribes in North Africa. The emirs of the Almoravid dynasty, who belonged to the Mâliki sect and showed great sensitivity to the prioritization of this sect, remained faithful to the establishment purpose of the state, consulted the scholars in their decisions and applied their fatwas and recommendations. This situation caused the influence area of the scholars to be quite wide. The Almoravid dynasty has been subject to various evaluations since its collapse, especially due to the fact that the scholars had great authority and the events that occurred with their fatwas. The Almohads -who put an end to this state and reigned on its territory-, the orientalists and also some researchers have approached the Almoravid dynasty from a completely negative point of view and made various accusations. On the other hand, the studies which respond to these accusations have been made and the works have been created in this respect especially in later periods. In this study, the authorities and responsibilities of the scholars, who had the authority to judge which was accepted as the most important authority in the Almoravid dynasty, were explained in the first place. Then, the relations of Yusuf b. Tashfin and Ali b. Yusuf b. Tashfin, who reigned during the peak periods of the state, with the scholars and the role of the scholars in important events and decisions were discussed. In the last part of the study, the position and influence of the scholars in the Almoravid dynasty were evaluated.

Kuzey Afrika’da kurulan bilâhare Endülüs bölgesini topraklarına dahil eden Murâbıtlar Devleti 448-543 (1056-1147) yılları arasında hüküm sürmüştür. Murâbıtlar Devleti’nin temeli Kuzey Afrika’daki kabileler arasında irşad ve tebliğ faaliyetinde bulunan ve bu maksatla bir ribat kuran Mâlikî fakihi Abdullah b. Yâsîn tarafından atılmıştır. Mâlikî mezhebine mensup olan ve bu mezhebin esas alınması hususunda büyük hassasiyet gösteren Murâbıtlar Devleti emîrleri devletin kuruluş gayesine sadık kalmışlar, karar alırken fakihlere danışmışlar, onların fetvâları ve tavsiyeleri doğrultusunda devleti yönetmişlerdir. Bu durum fakihlerin tesir sahasının oldukça geniş olmasına sebebiyet vermiştir. Murâbıtlar Devleti, fakihlerin bu devlette büyük bir otoriteye sahip olmaları ve bilhassa onların fetvâları ile vuku bulan hadiseler sebebiyle yıkılışından itibaren çeşitli değerlendirmelere konu olmuştur. Bu devlete son vererek bu devletin topraklarında hüküm süren Muvahhidler, müsteşrikler ve bir kısım araştırmacılar Murâbıtlar Devleti’ne tamamen olumsuz bir bakış açısıyla yaklaşmış, çeşitli ithamlarda bulunmuşlardır. Diğer taraftan bilhassa son dönemlerde bu suçlamalara cevap niteliği taşıyan çalışmalar da yapılmış, eserler ortaya konulmuştur. Bu çalışmada öncelikle Murâbıtlar Devleti’nde en önemli makam olarak kabul edilen kādılık makamını ihraz eden fakihlerin yetki ve sorumlulukları hakkında bilgi verilmiştir. Sonrasında devletin zirve döneminde hüküm sahibi olmuş Yûsuf b. Taşfîn ve Ali b. Yûsuf b. Taşfîn’in fakihlerle ilişkileri ile fakihlerin bu emîrlerin döneminde cereyan eden önemli hadise ve kararlardaki rolü ele alınmıştır. Çalışmanın son kısmında ise Murâbıtlar Devleti’nde fakihlerin konumu ve etkisi ile alakalı olarak yapılan değerlendirmelere yer verilmiştir.
