İş Sağlığı ve Güvenliği Konusunda Avrupa Birliği Uygulamaları ve Türkiye’ye Yansımaları

Özet
İş sağlığı ve güvenliği hem Uluslararası Çalışma Örgütü’nün hem de Avrupa Birliği’nin önem verdiği bir konudur. Öyle ki, ILO çıkarttığı sözleşme ve tavsiye kararlarında müstakil olarak iş sağlığı ve güvenliğine vurgu yapmıştır. Ayrıca güvenli ve düzgün iş anlamında kullanılan “decent work” konsepti ile ILO son yıllarda iş sağlığı ve güvenliği olgusunu çok daha geniş bir alana yaymaya çalışmaktadır. AB ise çalışma hayatında ILO sözleşme ve tavsiye kararlarını hem kendisi hem de aday ülkeler referans aldığı için iş sağlığı ve güvenliği hususunda geniş bir standartlaşma sağlamaktadır. Adaylık sürecinde önemli bir aşamaya gelen Avrupa Birliği’nin talepleri doğrultusunda Türkiye’de benzer süreçlerden geçmektedir. Türkiye’de ilk defa çıkarılan 6331 sayılı iş sağlığı ve güvenliği yasasına rağmen iş kazaları, özellikle tehlikeli sektörlerde artış göstermektedir. Yapılacak bu çalışma ile Avrupa Birliği sürecinde olan Türkiye’nin iş sağlığı ve güvenliği konusunda hem yasal hem de uygulamaya yönelik sorunları nasıl aşabileceği ve Avrupa Birliği mevzuat ve uygulamaları açısından eksiklerinin neler olduğuna dair tespitler yapılmaya çalışılacaktır.
Abstract
Health and safety at work is a subject which the European Union and International Labor Organization give the importance. Therefore, International Labor Organization especially focused on health and safety at work with its recommendations and conventions produced by the Organization. In addition, ILO is trying to spread the subject of health and safety at work issue by the "decent work" concept in the meaning of proper and safe work. The European Union adopts the conventions and recommendations produced by ILO to provide standardization on health and safety at work not only for the Union but also member countries. Turkey which has come to an important phase for the Union membership is passing from the same process with the demands of the European Union. Despite the new law no. 6331 related to Health and Safety at Work, which was enacted in 2012, there are still occupational accidents and health problems in sectors. With this working, health and safety at work issue in Turkey, which is in the process for the European Union membership, will be evaluated regarding related law, decrees and implementations. Also, the current related regulations and implementations will be examined according to the European Union rules.
