‘İşgal Edilmiş Devlet’: Modern Devletin İkili Yapısı Üzerine Kavramsal Bir Bakış

Özet
Modern devletin ikili yapısı demokrasinin işleyişi ve demokratikleşme tartışmalarında en fazla değinilen konulardan birisi de ola gelmiştir. Bu tartışmada ortaya çıkan durum böyle bir yapının demokratik sistem açısından sıkıntılara yol açtığıdır. Türkiye’de demokratikleşme anlamında en sorunlu alan olan devletin ikili yapısı ‘derin devlet’ kavramı ile ifade edilmiştir. ‘Derin devlet’ kavramı ile açıklanmaya çalışılan, devletin hukuk dışına taşan ya da taştığı iddia edilen gizli faaliyetleridir. Bu faaliyetlerle devlet ya da devlet içinde bir grup, -ya kendileri adına ya da başka bir devlet adına- rutin yasal olanın yani hukuka dayalı olan faaliyetlerinin dışına çıkar. Bu hukuk-dışı faaliyetler, ya devletin yasal kurumları tarafından mevcut kanunların dışına çıkılıp onlardan muaf olarak yapılır ya da gayr-ı yasal kurumlar veya kişiler tarafından yapılır. Buradaki en önemli sorun meşruiyet olarak ortaya çıkmaktadır. Bu grup, meşruiyetini demokratik değerlerden ziyade içeriğini kendilerinin tanımladığı ‘güvenlik’, ‘devletin ali çıkarları’, ‘genel yarar’ gibi kavramlar ile sağlamaya çalışır. Ne var ki, tüm güç güvenlik kuvvetleri ve paraya dayanan ‘zor’ kullanmadan gelir. Bu noktada kritik olan konu, Schmittyan bir bakış açısıyla bakarsak, karar alıcıların otorite ve meşruiyet anlamında bir yere dayanması gerektiğidir. Bir anlamda olumlama içeren ve tanım olarak da Türkiye’nin yüz yüze kaldığı bürokratik vesayet anlayışı ve uygulamaları ile örtüşmeyen bu kavramsallaştırmalar Türkiye gerçekliğini açıklamaktan uzaktır. Türkiye’de ortaya çıkan bürokratik vesayet durumunun aslında ‘bir işgal girişimi’ olduğu ileri sürülebilir. Bu nedenle, Türkiye’de demokratik sisteme geçtiğimiz 1950 yılından yakın zamana kadar olan durum ‘işgal edilmiş devlet’ kavramı ile daha iyi açıklanabilir.
Abstract
The dual structure of the modern state has been one of the subjects focused on in terms of the process of democracy and democratization discussions. Such a dual structure causes difficulties for democratic system. The dual structure of the state, the most problematic case in democratization of Turkey, was defined as “deep state”. The concept of “deep state” means the secret acts which spill over or alleged to spill over outside the rule of law. With these secret acts, the state or a group within the state - for themselves or for the sake of another state- went out of control in terms of law or law based rules. These out of law acts were either conducted by the state’s official institutions by going out of control of the civil law, or were by the corrupted groups or people. At that point, the most important problem is the legitimacy of these acts. Such a corrupted group derives their legitimization from the concepts like “security”, “the state’s crucial interests”, “general benefit” rather than democratic values. However, they just apply security force and the force based on money. At that point, the important case is, when we view by Schmittyan point of view, that the decision makers should be based on somewhere in terms of legitimacy and authority. These conceptualizations, which do not suit the bureaucratic tutelage that Turkey has encountered, and practices are away from interpreting the realities of Turkey. It can be alleged that the bureaucratic tutelage that Turkey has encountered is actually an attempt of invasion”. For that reason, the situation that covers the process from the year of 1950 when Turkey passed to democratic system, until the near past can be explained with the concept of “invaded state”.
