BASIC DYNAMICS OF OCCUPATIONAL HEALTH AND SAFETY SYSTEM IN REPUBLIC OF TURKİYE AND FIELD OF APPLICATION

Abstract
Occupational health and safety system in the Republic of Türkiye is based on the OccupationalHealth and Safety Law (OHS) No. 6331, which came into force on 30 June 2012. While there was nolaw specifically regulating occupational health and safety in the period before 30 June 2012, when İSGKwas not in effect, occupational health and safety was regulated in detail for the first time with the entryinto force of İSGK. While detailed regulations are made within the scope of İSGK, many newinstitutions have been introduced in terms of improving occupational health and safety, identifying andanalyzing risks, providing necessary health services and organizing occupational health and safety.Thus, it is aimed to ensure complete occupational health and safety and to establish a system. In thisstudy, the application area and basic dynamics of occupational health and safety in the Republic ofTürkiye were examined. In this way, it is aimed to find an answer to the question of whether theoccupational health and safety system in the Republic of Türkiye meets the needs for occupational healthand safety. Establishing a constantly changing and developing occupational health and safety system isof great importance in terms of identifying risks that threaten employee health, getting down to thesource of risks, taking necessary precautions, adapting the workplace to changing conditions andproviding a safe working environment in the workplace. As a result, it is very important that theoccupational health and safety system responds to new needs and that the occupational health and safetyrules are fully implemented in terms of both the protection of employee health and the safety of theworking environment.
Özet
İş sağlığı ve güvenliği temelde çalışan sağlığını esas alan bir kavramdır. İş sağlığı ve güvenliği bir taraftan çalışan sağlığını, diğer taraftan da iş güvenliğini amaçlamaktadır. Bu nedenle iş sağlığı ve güvenliğine dönük yapılan kanuni düzenlemeler büyük öneme sahiptir. Türkiye Cumhuriyeti'nde iş sağlığı ve güvenliği sistemi, 6331 sayılı İş Sağlığı ve Güvenliği Kanununa (İSGK) dayanmaktadır. İSGK'nin yürürlükte olmadığı dönemde iş sağlığı ve güvenliğini özel olarak düzenleyen herhangi bir kanun mevcut değil iken, İSGK'nin yürürlüğe girmesi ile ilk defa iş sağlığı ve güvenliği ayrıntılı şekilde düzenlenmiştir. İSGK kapsamında ayrıntılı düzenlemeler yapılmakla birlikte, birçok yeni müessese de getirilmiştir. Böylelikle iş sağlığı ve güvenliğinin eksiksiz sağlanması ve bir sistem oluşturulması amaçlanmıştır. Bu çalışmada Türkiye Cumhuriyeti'nde iş sağlığı ve güvenliğinin uygulama alanı ve temel dinamikleri incelenmiştir. Bu şekilde Türkiye Cumhuriyeti'nde iş sağlığı ve güvenliği sisteminin iş sağlığı ve güvenliğine yönelik ihtiyaçlara cevap verip vermediği sorusuna bir cevap aranmıştır.
