Kur’an ve Sünnet Bağlamında Müslümanın Öteki ile Komşuluğu

Özet

Sosyal bir varlık olan insanın ilk temas içerisinde olduğu yapı ailedir. Halka dışa doğru genişlemeye başladığında elbette ikincil muhatabımız komşularımızdır. Her ne kadar komşu seçme hakkımızın var olduğunu düşünsek de birçok yönü ile öteki olan insanlarla karşı karşıya olduğumuzun bilincinde olmak durumundayız. O halde bu ilişkinin sağlıklı zemine oturtulması gerekmektedir. Bir de bu komşuluk ilişkisine inanç başta olmak üzere birçok ayrıştırıcı unsur da dâhil olduğunda durum daha da karmaşık bir hal almaktadır. İşte bu çalışmamızda aslında İslâm’ın öteki olarak görmediği ancak bugün böyle bir tanıma mahkûm olan İslâm dışı unsurlarla komşuluk ilişkileri ortaya konmaya çalışılmıştır. Hukuk literatürü içerisinde müstakil başlıklar halinde ele alınan komşuluğun teorik ve hukuki boyutu tarihi örneklerle ele alınmıştır. İnsanlığın bir arada yaşama anlayışının ana iskeletini ortaya koyacak tarihi arka plan Kur’an ve Hz. Peygamber merkeze alınarak izah edilmiştir.

Abstract

As social beings, we experience relationships with the other first in the family. With the expansion of the circle of human beings around us, next people we come into contact are, most probably, our neighbours. Although we think that we have the right to choose our neighbours, we have to be aware that we are facing people who are other in many ways. Therefore, this relationship needs to be established on a healthy ground. The situation becomes even more complicated when many discriminating factors, especially belief, are included in this neighbourhood relationship. In this study, we have tried to reveal the neighbourhood relations with non-Islamic elements, which Islam does not see as the other but are condemned to such definition today. Dealt with under separate headings in the neighbourhood law literature, the issue has been discussed with some examples that have been applied differently from the theoretical and legal dimensions. The historical background that comprises skeleton of the idea of living together, which is the most fundamental problem of our age, is expounded by taking the Qur’an and the Prophet in the centre.
