The Approach of the European Court of Justice on the Qualification of Stand-by Time: An Evaluation As Part of Judgments of D.J. v Radiotelevizija Slovenija C-344/19, RJ v Stadt Offenbach am Main C-580/19, and MG v Dublin City Council C-214/20

Abstract

Directive 2003/88/EC of the European Union defines working time as any period during which the worker is working at the disposal of the employer and carrying out his activity or duties, in accordance with the national laws. Stand-by time can be defined as the period when the employee is ready to return to work as a result of a call made by the employer. Since Directive 2003/88 does not provide for any intermediate category, the stand-by periods of a worker must be classified as either working time or a resting period. European Court of Justice in the judgments of D.J. v Radiotelevizija Slovenija C-344/19, RJ v Stadt Offenbach am Main C-580/19, and MG v Dublin City Council C-214/20 has made some important evaluations on the stand-by period. The main legal question discussed in all three judgments is whether the stand-by time of the employees can be considered as “working time” within the scope of art.2 of the Directive. In our study, criteria developed by the European Court of Justice on whether stand-by time can be considered as working time will be discussed and evaluations will be made in the context of the obligation of employers to protect employees from psychosocial risks. In addition, suggestions will be made that employers should take into account the creation of a stand-by system according to the European Court of Justice.

Özet

2003/88 sayılı Avrupa Birliği Direktif’i çalışma süresini ulusal hukuka göre çalışanın işverenin emir ve talimatı altında iş gördüğü zaman dilimi olarak tanımlamıştır. Çağrıya hazır bekleme süresi ise çalışanın işverence yapılacak bir çağrı sonucu işe dönmeye hazır beklediği zaman kesitidir. Anılan Direktif çalışma süresi ve dinlenme süresi dışında ara bir kategori öngörmediğinden, çağrıya hazır bekleme süresinin çalışma yahut dinlenme süresi olarak sınıflandırılması gerekmektedir. Avrupa Adalet Divanı D.J. v Radiotelevizija Slovenija C-344/19, RJ v Stadt Offenbach am Main C-580/19 ve MG v Dublin City Council C-214/20 kararlarında çağrıya hazır bekleme süresinin nitelendirilmesine ilişkin önemli tespitlerde bulunmuştur. Belirtilen üç kararda da tartışılan temel hukuki sorun çalışanın çağrıya hazır bekleme süresinin söze konu Direktif md.2 kapsamında “çalışma süresi” olarak kabul edilip edilmeyeceğidir. Çalışmamızda kararlarda belirtilen çağrıya hazır bekleme süresinin hangi hallerde çalışma süresi olarak kabul edileceğine ilişkin Divan tarafından geliştirilen ölçütler incelenecek ve işverenin psikososyal risklere karşı işçiyi koruma yükümlülüğü bağlamında tespitlerde bulunmaya çalışılacaktır. Bununla birlikte Adalet Divanı’nın kararları esas alınarak çağrıya hazır bekleme sisteminin oluşturulmasında işverenlerin dikkate alması gereken hususlara ilişkin de önerilerde bulunulacaktır.
