TAHARRÎ/TEVAHHÎ AS A METHOD OF IJTIHAD IN THE ISLAMIC LAW

Abstract
Taharrî/tevahhî is one of the important concepts of fiqh -Islamic law-. It is to give the most accurate judgment by using the evidence, signs and indications available to judge in an affair that related to the Shari’a which is similar or intermingled with the broadest sense and has no definite information about it. If these are not available, then it is an effort to choose the most suitable one with his own foresight. In terms of content, scope and judgment, it is different from concepts such as Ijtihad -jurisprudence, ihtiyat -precaution-, zan/shak -doubt- and vehm - suspicion-. At the same time, according to some of the scholars of Islamic law, taharrî is one kind of ijtihad or ihtiyat –precaution-. But there is a majority of who claim the more strong relationship between taharri and ijtihat. Almost, there is no disagreement between scholars of Islamic law about to be its evidence. In practice, two situations arise in which it is permissible and not permissible. In both cases, important principles of the fıgh prevailed in Qavâid –rules-works. Some rules of them such as that “at the absence of proof, taharri would replace with religious (Şer’i) proof,” “taharri just can be permissible at the halal stuff in the compulsory situation”, “at the chastity issues taharri is not proper” attract attention. It has been seen that the most issues that taharri can be allowed are prayer one according to boks containing topic of taharri. Whereas, the situations that taharri is not allowed come forward mostly about chastity issues. In the article, the nature of the taharri/tawahhi concept, its support, and the meaning framework pointed out by the related principles are discussed. Nevertheless, attempts have been made to determine the nature and boundaries of the permissive or non- permissive situations.

Taharrî/tevahhî, İslam hukukunun önemli kavramlarından biridir. En geniş anlamıyla, benzeşen veya birbirine karışan ve hakkında kesin bilgi bulunmayan şer‘î bir meselede hüküm vermek için mevcut delil, işaret ve emareler kullanılarak zann-ı galiple, bunlar da yoksa sezgiyle (feraset) en uygun olanı tercih etme çabasıdır. Mahiyet, kapsam ve hükme delâleti bakımından, taharrî; ictihad, ihtiyat, zan/şek ve vehm gibi kavramlardan farklılık arz etmektedir. Bununla birlikte bazı İslam hukukçularına göre taharrî, bir çeşit ictihad veya ihtiyattır. Ancak taharrî ile ictihad arasındaki ilişkinin nispeten daha sıkı olduğunu söyleyenler çoğunluktadır. Hücciyeti hususunda ise fakihler arasında neredeyse ihtilaf bulunmamaktadır. Öte yandan uygulamalarda taharrinin caiz olduğu ve caiz olmadığı şeklinde iki durum ortaya çıkmaktadır. Her iki durumun bir ifadesi olarak kavâid-i fıkhiyye türü eserlerde bir kısım kâideler yer almıştır. Bunlardan “delillerin yokluğunda taharrî, şer‘î delilin yerine geçer”, “taharrî ancak zaruret sebebiyle helal olan şeylerde caizdir”, “namus (avret) konularında taharrî sahih değildir” şeklindeki kâideler en önemli olanlarıdır. Taharrî konusunu ele alan eserlerde taharrinin caiz olduğu durumlar, en çok ibadetlere ilişkin meselelerde görülmektedir. Buna karşılık caiz olmayan durumlar daha ziyade ırz/namus meselelerinde öne çıkmaktadır. Makalede, taharrî/tevahhî kavramının mahiyeti, dayanağı, ilgili kâidelerin işaret ettiği anlam çerçevesi ile taharrî yönteminde caiz olan veya olmayan durumların mahiyet ve sınırları belirlenmeye çalışılmıştır.
