Özet
İslâm Hukuku’nda talâk esasen erkeğe/kocaya verilmiş bir haktır. Koca, eşinden ayrılmak istediğinde söz konusu yetkiye dayanarak mahkemede boşanma davası açmaksızın boşama iradesini beyan eden ifadelerle eşini boşayabilir. Kocaya verilen söz konusu yetki günümüzde, özellikle inanç zaafının ve cehaletin hüküm sürdüğü bir toplumda, boşanma olaylarının aşırı derecede çoğalması, bundan ötürü aile fertlerinin mağdur duruma düşmesi gibi birçok istenilmeyen sonuçlara neden olabilmektedir. Buna karşı talâk yetkisinin kocanın kayıtsız şartsız kullanabileceği bir hak olmaktan çıkarılıp idarecilerin denetimi altına alınarak belli bir usule tabi tutulması günümüz şartları açısından ehemmiyet taşımaktadır. Bu çalışmada, kocaya özgü olarak tanınan talâk yetkisinin idare tarafından sınırlandırılması problemi şerî deliller ışığında ele alınmıştır.
Abstract
In Islamic law, Talaq – the right to declare a divorce between a woman and a man, is granted only to a man. A man, on the basis of the right granted, can terminate his marriage without going to court, using special words proving his intention to divorce. This right granted to a man led to a sharp increase in the number of divorces in society, to some extent losing universal values and morality, where ignorance is widespread, which, accordingly, leads to the suffering of all family members, especially children. One of the pressing issues of our time is the transfer of the right to the Talaq under the control of the authorities and the imposition of necessary restrictions on it in order to prevent the conflicts mentioned above and to prevent the use of the right Talaq at its discretion. The article deals with the problem of the restriction by the authorities of the right to Talaq granted to men from the point of view of Shariah.
