THE RIGHT TO SOCIAL SECURITY AND ITS REFLECTIONS TO 1982 CONSTITUTION

Abstract

Social security is as old as humanity and universal. The right to social security as a result of a difficult process reached its present state. Socialist and liberal thought systems have different views on this issue. The industrial revolution has not only changed the economic structure also transform social and cultural structure. The basic condition for a life worthy of human dignity driving is to have the right to social security. This right its place in the international agreements and conventions, is a basic human right. The effect of the right to social security is seen both the 1982 Constitution and the Constitutional Court decision. The aim of this study is to provide a theoretical framework for the concept of the right to social security and the examining this concept the implications of the 1982 Constitution to examine in the framework of the 1921, 1924 and 1961 Constitution with Supreme Court case laws.

Sosyal güvenlik ihtiyacı insanlık tarihi kadar eski ve evrenseldir. Sosyal güvenlik hakkı bugünkü durumuna zorlu bir süreç sonucunda ulaşmıştır. Sosyalist ve liberal düşünce sistemleri bu konuda farklı görüşlere sahiptir. Sanayi devrimi sadece ekonomik yapıyı değiştirmiş aynı zamanda sosyal ve kültürel yapıyı da dönüştürmüştür. İnsan onuruna yakışır bir yaşam sürmenin temel koşulu, sosyal güvenlik hakkına sahip olmaktır. Uluslararası anlaşma ve sözleşmelerde kendine yer bulan bu hak, temel bir insan hakkıdır. Sosyal güvenlik hakkının etkisi hem 1982 Anayasası’nda hem de Anayasa Mahkemesi kararlarında görülmektedir. Bu çalış- manın amacı, sosyal güvenlik hakkı kavramına ilişkin teorik bir çerçeve sunmak ve 1982 Anayasası’na yansımalarını; 1921, 1924 ve 1961 Anayasaları ile Anayasa Mahkemesi İçtihatları çerçevesinde irdelemektir.
