THE PHILOSOPHY OF PROPERTY RIGHTS

Abstract

The philosophy of property rights serves to analyze of such things as possession and ownership. Property refers to rules governing access to and control of all kind of possessions (land, material resources, intellectual goods and services etc). The concept of property in economics is not the same as used in law. In economics, property simply means ownership. However, property as a legal term refers to the general framework and limits of ownership rights. The philosophy of property rights focus on discussions about the justification of property. The main discussion in the philosophy of property rights is whether “private property” is legitimate right or not. This short paper aims to explore the justification of property rights.

Mülkiyet hakları felsefesi, sahiplik ve mülkiyet meselelerini inceleyen bir alandır. Mülkiyet genel olarak insanın bir mal üzerinde sahip olma, sahip olduğu malı üzerinde istediği şekilde tasarrufta bulunabilme, ürünlerinden ya da semerelerinden yararlanma ve bu malı başkalarına devredebilme haklarını kapsayan bir kavramdır. İktisadi anlamda mülkiyet kavramı iktisadi kaynakların aidiyetinin, tasarrufunun ve kullanımının düzenlenmesi anlamına gelir. Hukuki açıdan mülkiyet kavramı ise kullanma, yararlanma, tasarruf gibi kişisel ve ayni hakların anayasal ve yasal çerçevesini ve sınırlarını ifade eder. Mülkiyet hakları felsefesi, mülkiyetin meşruiyeti meselesi ile ilgilenir. Mülkiyet hakları felsefesinde özel mülkiyet hakkının meşru bir hak olup olmadığı ana tartışma konusudur. Bu kısa çalışmanın amacı mülkiyetin meşruiyeti konularındaki felsefi görüşleri ve tartışmaları özetlemektir.
