The European Order for Payment Procedure

Abstract

European Procedure of Order for Payment Without Judgement provides the pecuniary claims arising from cross border legal transactions regarding civil and commercial law to be resolved and enforced. Printed forms including all the demands, statements and decisions have been issued in order to be used in the mentioned procedure. European Procedure of Order for Payment is one-staged. Because only the European Order for Payment has to be notified as the court decision. The only means which the opposite party has against the order for payment is to convert the dispute to a case by objection. In this way the European Procedure of Order for Payment differs from the German Procedure of Order for Payment and functions faster. The European Order for Payment has the feature of being enforced in all member states without a procedure of adoption.

Özet

Avrupa İlâmsız İcra Usulü, hukuki ve ticari sınır aşan hukuki işlemlerden doğan para alacaklarını hükme bağlatma ve icra ettirme imkânı sağlamaktadır. Söz konusu usulde kullanılmak üzere tüm talepler, beyanları ve kararlar için matbu formlar çıkarılmıştır. Avrupa ilamsız icra usulü tek derecelidir. Zira mahkeme kararı olarak sadece Avrupa Ödeme Emri tebliğ edilmek zorundadır. Ödeme emrine karşı, karşı tarafın elindeki tek imkân itiraz etmek suretiyle uyuşmazlığın davaya dönüşmesini sağlayabilmektir. Böylelikle Avrupa İlamsız İcra Usulü, Alman İlamsız İcra Usulü’nden ayrılmakta ve daha hızlı işlemektedir. Avrupa Ödeme Emri, ek bir tanıma prosedürüne ihtiyaç duyulmaksızın üye tüm ülkelerde icra edilebilme özelliğine sahiptir.
