Social Change and Islamic Law

Abstract

We are in the age of change. Community life is reshaping almostevery day. Lifestyles, social tastes, moral attitudes, and behaviorsare constantly changing. Briefly, a wide-ranging change in everyfield continues on its way irresistibly and rapidly. It is clear thata change that its borders are not certain often ends up in socialinstability. The last goal to be reached by social developmentalways includes certain relativity. These and similar reasonssupport the change positively and show that a compass is neededto serve the order and stability of society. In our opinion, thiscompass is the norms of religion and law. Islamic Law/Fıqh,because it is a legal system originating from the revelation,considers the aim of religion and law together. In takes intoaccount the direction determined by religious and legal provisionand principles, in the realization of these objectives. In this way,it allows for the formation of a social order based not only on thebenefits of individuals but also the whole of society. This article has been written in order to shed light on the fact that IslamicLaw is a compass that leads the society to the goal in the processof change, a means to help to process and a range of values thatmaintain both.

Değişim çağındayız. Toplum hayatı neredeyse her gün yenidenşekilleniyor. Yaşam tarzları, toplumsal beğeniler, ahlâkî tutumve davranışlar sürekli değişiyor. Kısaca her alanda karşımıza çıkangeniş çaplı bir değişim, karşı konulamaz bir şekilde ve hızlayoluna devam ediyor. Sınırları belirsiz bir değişim çoğunluklatoplumsal istikrarsızlıkta son bulur. Toplumsal gelişmeyle ulaşılmakistenen son hedef ise her zaman belli bir izafiliği içerir.Bu ve benzeri gerekçeler, değişimi olumlu yönde destekleyerek,toplumun düzen ve istikrarını sağlamaya hizmet edecek bir pusulayaihtiyaç duyulduğunu gösterir. Kanaatimizce, bu pusuladin ve hukuk normlarıdır. İslâm Hukuku/Fıkıh, vahiy kaynaklıbir hukuk sistemi olması sebebiyle, dinin ve hukukun öngördüğügayeleri birlikte gözetir. Bu gayelerin gerçekleşmesinde, dînîve hukukî hüküm ve ilkelerin belirlediği istikameti dikkate alır.Böylece, yalnızca fertlerin değil, toplumun tamamının maslahatınıesas alan toplumsal bir düzen oluşmasına da imkân tanır. Bumakale, İslâm Hukuku’nun, değişim sürecinde toplumu hedefeulaştıran bir pusula, sürece yardımcı olan bir vasıta ve her ikisinimuhafaza eden değerler manzumesi oluşuna ışık tutmak gayesiile kaleme alınmıştır.
