Abstract

Adopted by the Ru school, founded by Confucius, and especially after the Han dynasty (202 BC-220 AD) in China's imperial period, two different understandings of justice, “concealment among relatives” and the “punishing one's own relations in the cause of justice”, which emerged during the period of Chun Qiu(770 BC-476 BC) and was appreciated by people had maintained their mutual existence in Chinese history. These two conceptions of justice directly influenced China's imperial period (212 BC-1912 AD) and even the modern period legal system.However, as a result of the adoption of the Ru school of the sovereigns during the Han dynasty, the main basis of the Ru school, “ritual” (li 礼), was included in the laws, and the principle of staying faithful to the fidelity among the relatives which is the most basic of the traditions was protected by laws. This legal protection continued to exist during the periods of the later emperors. This understanding adopted by the Chinese feudal legal system against the pure understanding of justice, although it was subjected to various criticisms such as favoritism of the offender and hindrance of the finalization of justice, it has been extended and regulated in the laws and has continued its effect in a long historical process as a typical sign of the enactment of ritual. In contemporary law, there are similar norms implemented by various countries in different ways. Although these norms are interpreted in different ways in the doctrine, the main point is that the natural principles of human existence should be included to a certain extent in state laws.

Özet

“Akrabanın suçunu gizleme” anlayışı Konfuçyüs’ün kurucusu olduğu Ru ekolü tarafından benimsenmektedir. Özellikle Han Hanedanlığı (HanChao汉朝) döneminden (M.Ö 202-M.S 220) sonraki Çin’in imparatorluk dönemi hukuk sisteminde önemli yer utmaktadır. Bu anlayış ile Chun Qiu (春秋) döneminde (M.Ö 770-M.Ö 476) ortaya çıkan, ve sonraki uzun tarihi süreçte zamanla halk arasında kendine yer bulan “adalet için akrabadan dahi vazgeçmek” (dayimieqin 大义灭亲) anlayışı iki farklı adalet anlayışı olarak Çin topraklarında uzun tarihi süreçte beraber varlığını sürdürmüştür. Bu iki adalet anlayışı Çin’in imparatorluk dönemi (M.Ö.221-M.S 1912) hatta modern dönem hukuk sistemini doğrudan etkilemiştir.Ne var ki, Han Hanedanlığı döneminde hükümdarların Ru ekolünü benimsemeleri sonucunda, Ru ekolünün temel dayanağı olan “örf-adet”in (li 礼) yasalarda yer almaya başlamıştır. Bununla beraber örf-âdetin temeli olan akrabalar arasındaki vefa borcuna sadık kalma anlayışı yasalarla korunmaya alınmıştır. Bu yasal koruma sonraki imparatorluk dönemlerinde de varlığını sürdürmüştür. Salt adalet anlayışına karşı, özellikle Çin feodal hukuk sisteminin benimsediği bu anlayış, suçluyu kayırma, adaletin sağlanmasına engel olma gibi çeşitli eleştirilere maruz kalmasına rağmen, yasalarda kapsamı genişletilerek düzenlenmiştir. Ve örf-adet kurallarının yasalaşmasının tipik belirtilerinden biri olarak uzun tarihi süreçte etkisini devam ettirmiştir.Çağdaş hukuk kurallarında çeşitli ülkeler tarafından farklı şekillerde hayata geçirilen benzeri düzenlemeler yer almaktadır. Bu düzenlemeler doktrinde farklı açılardan yorumlansa da, temel çıkış noktası insanın insan olarak var oluşundaki doğal prensiplere devlet yasalarında belirli ölçüde yer verilmesi gerekliliğidir.
