EDUCATION RIGHTS OF GIFTED CHILDREN

Abstract
Gifted children are defined as children who perform better than their peers in areas such as sport, art, and creativity. Gifted children face many problems in their education. They are excluded because they are different from their peers in the education process; they seem to have prejudiced that they do not need any extra training because they are superior talents. It is also a fact that educational environments are not structured for the needs of gifted children. It is necessary to regulate the education for the gifted children in accordance with their needs and from the perspective of equality of opportunity and to ensure the right of education in terms of interests, abilities and capacities. In this study, the current situation of the education of gifted children will be introduced regarding with national and international practice and human rights violations in the context of the education of gifted children in Turkey will be discussed.
Özet
Üstün yetenekli çocuklar, spor, sanat, yaratıcılık gibi alanlarda yaşıtlarına göre daha yüksek performans gösteren çocuklar olarak tanımlanmaktadır. Üstün yetenekli çocukların eğitim hayatında pek çok sorunla karşılaştığı bilinmektedir. Eğitim sürecinde yaşıtlarından farklı oldukları için dışlandıkları; üstün yetenekleri olduğu için fazladan bir eğitime gereksinim duymadıkları yönünde önyargılarla karşılaştıkları görülmektedir. Ayrıca eğitim ortamlarının üstün yetenekli çocukların ihtiyaçlarına yönelik olarak yapılandırılmadığı da bir gerçeklik olarak karşımıza çıkmaktadır. Üstün yetenekli çocukların eğitim hayatlarının gereksinimleri doğrultusunda fırsat eşitliği perspektifinden hareketle düzenlenmesi ve eğitim haklarının ilgi, yetenek ve kapasiteleri doğrultusunda sağlanması gereklidir. Bu çalışmada üstün yetenekli çocukların eğitim ihtiyaçlarının ve uygulamaların mevcut durumu ulusal ve uluslararası hukuk çerçevesinde ortaya konulacak ve hak ihlalleri bağlamında Türkiye’de üstün yetenekli çocukların eğitimi tartışılacaktır.
