A Functional Regime of Public Officers from a Historical Evolution Perspective

Abstract

Since the Ottoman Empire, public officers have been key in the organization of the administrative structure. The principal system to shape the working principles and modalities of public officers has been named as the public personnel regime. In the evolution of this regime, there are two definitive milestones in the historical plane: Edict of Gülhane in 1839 and Public Officers Law of 1965. From this perspective, the study provides an overview of the Turkish regime of public officers and on this background suggests a merit-based regime of public officers with relevant examples.

Özet

Osmanlı Devleti’nden günümüze kadar idari teşkilatın en önemli unsuru kamu personelidir. Bu personelin çalışma prensiplerini ve çalışma şekillerini biçimlendiren ana sistem ise, kamu personeli rejimi olarak adlandırılmıştır. Bu rejimin gelişim süreci göstermektedir ki, tarihsel akış boyunca iki olay ön plana çıkmış ve belirleyici kimliğe sahip olmuştur. Bunlardan ilki 1839 yılında Tanzimat Fermanı’nın ilan edilmesi, ikincisi ise 1965’te Devlet Memurları Kanunu’nun kabul edilmesidir. Bu sebeple çalışmada bu tarihler esas alınarak Türk kamu personel rejimi incelenmiş ve kurulan bu altyapının üzerine de liyakatin esas alındığı bir personel rejimi için önerilere yer verilerek çalışma tamamlanmıştır.
