A Regulation Analysis on the Protection of Financial Consumers: The Banking Product and Service Costs Regulation Example

Abstract
This research aims to investigate the regulation process of banking product and service costs carried out by the Banking Regulation and Supervision Agency (BRSA) in 2014, an implementation closely concerning millions of financial consumers, basing on a case study and analyze the matter from different perspectives. The findings and results indicate that not only the regulation fails to protect financial consumers, but also it solves the problems between banks and financial consumers while at the same time emphasize that the BRSA largely disregarded judicial decisions which were in favor of financial consumers while preparing the mentioned regulation and that in this regard, it needs to be reiterated.
Özet
Bankacılık Düzenleme ve Denetleme Kurumu (BDDK) tarafından 2014 yılında gerçekleştirilen ve Türkiye’deki milyonlarca finansal tüketiciyi son derece yakından ilgilendiren bankacılık ürün ve hizmet ücretleri regülasyon sürecini vaka çalışması olarak ele alıp, konuyu farklı açılardan analiz etmeyi amaçlayan bu araştırmanın bulgu ve sonuçları; düzenlemenin finansal tüketicileri korumakta ve bankalar ile finansal tüketiciler arasındaki problemleri çözmekte yetersiz kaldığına işaret ettiği gibi, ilgili düzenleme hazırlanırken, BDDK’nun finansal tüketiciler lehine oluşmuş yargı kararlarını büyük oranda dikkate almadığına ve bu bağlamda düzenlemenin yeniden ele alınması gerekliliğine de, vurgu yapmaktadır.
