Legal Transactions for Workplace Transfer in the Turkish Labor Law

Abstract

Workplace Transfer, economic and technical purpose of the establishment established with all the elements in order to maintain economic integrity, rights and debts with a legal process to transfer to another employer and the employer management of the employer to continue to operate as a business activity. In our law, it is stated that the transfer of the workplace will be done by a legal procedure in the regulation of the Article 6 of the Labor Law on the transfer of the work, however no restriction has been made. In the case of the transfer of part of the workplace or work place to comply with the statutory regulations, regardless of the type of legal transaction, the workplace transfer will be mentioned. In this study, it is tried to explain the legal procedures that cause the transfer of the workplace in general terms.

Özet

İşyeri devri, ekonomik ve teknik amacını gerçekleştirmek için kurulmuş işyerinin bütün unsurlarıyla birlikte ve ekonomik bütünlüğü korunarak, hak ve borçlarıyla hukuki bir işlemle başka bir işverene devri ve devralan işveren yönetiminde işyerinin faaliyete devam etmesi olarak tanımlanabilir. Hukukumuzda işyeri devrine dair İş Kanunu’nun 6. madde düzenlemesinde işyeri devrinin hukuki bir işlemle yapılacağı belirtilmiş fakat herhangi bir sınırlamaya gidilmemiştir. İşyeri veya işyerinin bir bölümünün devri halinde kanuni düzenlemeye uyması halinde hukuki işlemin türüne bakılmaksızın işyeri devrinden söz edilecektir. Bu çalışmada işyeri devrine neden hukuki işlemler genel hatlarıyla anlatılmaya çalışılmıştır.
