THE TERM OF REMOVING FOR SALE OF THE ATTACHED ASSETS ON PROCEDURE FORCED COLLECTION OF PUBLIC RECEIVABLES: THREE MONTHS OR THREE YEARS?

Abstract

The collection of taxes, the main financial sources for the public services, and of other financial obligations on time, and their pass to treasury is absolutely crucial in terms of working properly of the services provided by government. For this purpose, if the public payments are not paid on time, for the applications of the procedures will be implemented in a different procedure from legal proceeding and collecting of private, Law No: 6183 Amending Law on The Procedure for The Collection of Public Receivables and Some Other Laws is granted. In the aforementioned law, the most effective procedure of forced collecting is attachment. According to the 84. Clause of the Law regulating the selling of the confiscated goods, after the day in which attachment is committed, even if it regulates that it will be put for sale in three months, It takes places in the governmental view and judicial decisions about that when it is not atttached to the time, the attachment on goods will not be released or the government can’t be charged with any responsible for it. In this study, we will reveal the disadvantages of the extension of the offering time for an attached property by the management despite the legal regulation in an implementation like distraint which effects significantly the ones who have public debts. In addition, we will try to mention about the legal arrangements which need to be done, by indicating the justifications a regulation applied for private debts like the provision ‘failing to comply the offering time for seized property release the attachments on the property’ take part in Enforcement and Bankruptcy law, can be possible for public debts as well.

Özet

Kamusal hizmetlerin temel finansman kaynağı olan vergiler ve diğer mali yükümlülüklerin zamanında tahsil edilip hazineye intikal etmesi, devletin sunmuş olduğu hizmetlerin aksamaması bakımından elbette önemlidir. Bu amaçla, özel alacakların takip ve tahsil usulünden farklı olarak, kamu alacaklarının zamanında ödenmemesi halinde uygulanacak usuller için 6183 sayılı Amme Alacaklarının Tahsil Usulü Hakkında Kanun kabul edilmiştir. Mezkûr Kanun’da en etkili cebri tahsil yolu hacizdir. Kanun’un mahcuz menkul malların satışını düzenleyen 84. Maddesinde, “haczin yapıldığı tarihin üçüncü gününden itibaren üç ay içinde satışa çıkarılacağı” düzenlenmişse de bu süreye uyulmamasının mal üzerindeki haczi kaldırmayacağı ya da idareye herhangi bir sorumluluk yüklenemeyeceği hem idarenin görüşünde hem de yargı kararlarında yer bulmaktadır. Biz bu çalışmamızda, haciz gibi kamu borçlularını önemli ölçüde etkileyen bir uygulamada mahcuz bir malın satışa çıkış süresinin kanuni düzenlemeye rağmen idarece uzatılabilmesinin sakıncalarını ortaya koyacağız. Ayrıca, özel alacaklar için uygulanan İcra ve İflas Kanunu’nda yer alan “hacizli malların satışa çıkış süresine uyulmamasının mallar üzerindeki haczi kaldıracağı” hükmüne benzer bir düzenlemenin, kamu alacakları için de mümkün olabileceğini gerekçeleri ile belirterek, yapılması gereken hukuksal düzenlemelere değinmeye çalışacağız.
