Is giving a present to a civil servant bribe?

Abstract
The Law on Civil Servants strictly forbids that civil servants derive personal benefits and receive presents during or outside their duties, and because of their duties. In “Devlet Adamlarına Öğütler” written by the Head of Provincial Treasury, Sari Mehmet Pasha, who lived in the 16th century, summarised our subject with these words: “…There is no bigger sin than leaving a task which should be fulfilled according to the laws and doing something bad which is against the law just because of receiving bribe. And there is no illness whose cure is either difficult or impossible to find like bribery for the statesmen; therefore, one must think thoroughly and avoid this. However, if that person’s close friend brings him a present, there is no obstacle in receiving that present. And this present should not be for receiving something in return, but for increasing their close friendship.”
Özet
Devlet memurlarının görevleri esnasında veya görevleri dışında görevlerinden dolayı herhangi bir şekilde kişisel menfaat sağlamaları ve hediye kabul etmeleri Devlet Memurları Kanunu’nda açık bir şekilde yasaklanmıştır. 16’ncı yüzyılda yaşamış olan Defterdar Sarı Mehmet Paşa’nın rüşvet ve hediye konusunda “Devlet Adamlarına Öğütleri”nde; “…Allah korusun kanuna göre yapılması lâzım gelen işleri rüşvet ile geri bırakıp yasaya aykırı kötü bir işi işleme kadar büyük bir günah yoktur. Ve devlet sahiplerine rüşvet hastalığı gibi ilâcı müşkül belki ilâcı yok bir devasız hastalık yoktur, iyi düşünüp bundan son derece perhiz etmek ve çekinmek lâzımdır. Meğer ki kişinin kendi dostu bir hediye getire, bu hediyeyi almakta sakınca yoktur. O da bir nesne dolayısıyla olmaya; ancak sevginin artmasını sağlamak niyeti ile ola…” şeklindeki ifadesi konumuzun özetini gayet güzel vermektedir.
