Evaluation of some provisions in ınheritance and gift tax law and tax procedure law concerning legality principle

Abstract
The principle of legality of taxation and punishments is explicitly regulated in our Constitution. The exceptions of this principle are also regulated by the Constitution. However it is seen that some provisions are included in some acts which are contrary to the principle of legality of taxation and punishments. In this study, the authorities of the Council of Ministers to determine the amount of tax base of the inheritance and gift tax, given by article 16/3 of Inheritance and Gift Tax Law, and to alter tax fines, given by the article 414/3 of the Tax Procedure Law are examined in terms the principle of legality. It is concluded that the article 16/3 of the Inheritance and Gift Tax Law is contrary to the article 73 of the TC regulating the principle of legality of taxation and the article 414/3 of the Tax Procedure Law is contrary to the article 38 of the TC regulating the principle of legality of punishments.
Özet
Anayasamızda vergilerin ve cezaların kanuniliği ilkeleri açık bir biçimde düzenlenmiştir. Bu ilkelerin istisnaları da bizzat Anayasa tarafından öngörülmüştür. Ancak çeşitli kanunlarda vergilerin ve cezaların kanuniliği ilkelerine aykırı düzenlemelerin yer aldığı görülmektedir. Bu çalışmada Bakanlar Kuruluna; Veraset ve İntikal Vergisi Kanununun (VİVK) 16/3. maddesinde verilen vergi tarifesinin matrah dilim tutarlarını belirleme yetkisi ve Vergi Usul Kanununun (VUK) mükerrer 414/3. maddesinde verilen vergi cezalarında değişiklik yapma yetkisi vergilerin ve cezaların kanuniliği ilkesi çerçevesinde değerlendirilmektedir. Çalışmada VİVKnin 16/3. maddesinin Anayasanın vergilerin kanuniliğini düzenleyen 73. maddesine, VUKun 414/3. maddesinin ise Anayasanın cezaların kanuniliğini düzenleyen 38. maddesine aykırı olduğu kanaatine ulaşılmıştır.
