A VIRUS HIDDEN IN THE RATIONALE OF FRANCE’S LAW CRIMINALIZING GENOCIDE DENIAL)

FRANSA’NIN SOYKIRIMI SUÇUNUN İNKÂRINI CEZALANDIRMA YASASININ GEREKÇESİNE YÜKLENEN VİRÜS

Abstract

This article examines the justification of draft law in France that was introduced to the Parliament by the Government on 13 April 2016 and accepted on 1 July 2016, and which changes some of the articles of the Equality and Citizenship law and one article of the Press law. This new law was President of France François Hollande’s attempt to revive the “law about the penalization of those who deny the Armenian genocide” that was annulled by the Constitutional Court of France due to it being contrary to the Constitution and freedom of thought and expression, and was prepared by the famous jurist Jean-Paul Costa who had retired from being the President of the ECHR. Despite the fact that the text of the law gives no place to the term “Armenian genocide”, this law was nevertheless presented by the Government of Armenia and the Armenian diaspora, and the French, Armenian and Turkish press as “France has again accepted a legislation that penalizes the denial of the Armenian genocide”. Indeed, this presentation can be seen as an initiative by French politicians who seek to gather Armenians’ votes during the presidential election to be held in 2017. Through this law, the French Government attempted to bypass the annulment verdict previously delivered by the Constitutional Court of France, and this was arranged through the justification of the law. As can be seen, the French Government has indicated that the justification of the law was about conformity with the EU “Framework Decision on Combating Certain Forms and Expressions of Racism and Xenophobia”

Bu çalışma 13 Nisan 2016’da Fransa’da hükümet tarafından YasamaMeclisi’ne sunulan ve 1 Temmuz 2016’da kabul edilen Eşitlik ve Yurttaşlıkyasasının bazı maddeleri ile Basın yasasının bir maddesini değiştiren yasataslağının gerekçesini incelemektedir. Bu yeni yasa daha önce FransaAnayasa Konseyi tarafından “Ermeni soykırımını inkar edenlerincezalandırılmasına dair kanunu” anayasaya ve düşünceyi ifadeözgürlüğüne aykırı olduğu gerekçesi ile iptal edilen kanunu canlandırmagirişimi olarak Fransa Cumhurbaşkanı François Hollande’ın girişimiAİHM başkanlığından emekli olmuş ünlü hukukçu Jean-Paul Costa’nınbaşkanlığında hazırlanmış bir yasadır. Yasa metninde Ermeni soykırımıterimine yer verilmemesine rağmen, bu yasa, Ermenistan Hükumeti ileErmeni diasporası ve Fransız, Ermeni ve Türk medyaları tarafından“Fransa Ermeni soykırımının inkarını cezalandıran mevzuatı yeniden kabuletti” şeklinde tanıtılmıştır. Nitekim bu yorum, 2017’de yapılacak Başkanlıkseçimlerinde Ermenilerin oylarını almak isteyen Fransız politikacıların birgirişimi olarak görülebilir. Bu yasa ile Fransız Hükumetinin, FransaAnayasa Konseyinin daha önce verdiği iptal kararı by-pass edilmeyeçalışılmış, bu ise yasanın gerekçesi üzerinden düzenlenmiştir. Görüleceğigibi Fransız hükümeti bu yasaya AB “Irkçılık ve Yabancı Düşmanlığı ileMücadele ve Soykırımı ile İnsanlığa Karşı Suçların İnkârınınCezalandırılmasına ilişkin Çerçeve Kararı”na uyum gerekçegösterilmektedir
