An Approach on the Concept of Religious /Islamic Law or on the Philosophy-Religion and Law Relationship

Dinsel/İslami Hukuk Kavramı ya da Felsefe-Din ve Hukuk İlişkisi Üzerine Bir Yaklaşım

Abstract

The society’s legitimacy of law is, no doubt, of great importance for social peace and well-being. But then, how could this be achieved? In another interpretation, could “human/legal law” and “religious/Islamic law” be assessed as the concepts and phenomena that coincide/converge in essence? In terms of social life, is the concept of “justice”, that is important in terms of social morality and law, constituting one of the fundamental values ofreligion/Islam, and at the same time as the humanization of life in terms of the establishment of a just and well-being world, theoretically and empirically functioning adequately in our lives? The purpose of this study is nothing but to try to open a horizon and an attempt to make a contribution in this context.

Özet

Toplumun hukuku ‘meşru’ addetmesi toplumsal barış ve esenlik için büyük önem arz eder kuşkusuz. Peki, bu nasıl sağlanabilir? Başka bir anlatımla “İnsanlığın hukuku/beşeri hukuk” ile “dinsel/İslami hukuk”, özü itibariyle, çakışan/çakışabilen kavram ve olgular olarak değerlendirilebilir mi? Toplumsal yaşam açısından, adil ve esenlikli bir dünyanın kurulabilmesi açısından, yaşamın insanileştirilmesi açısından, toplumsal ahlak ve hukuk açısından önemli olan ve aynı zamanda dinin/İslamiyet’in temel değerlerinden birisini oluşturan “adalet” kavramı teorik ve olgusal olarak hayatımızda yeterince ve bihakkın işlevselleşebilmiş midir?Çalışmanın amacı, belirtilen bağlamda katkı sunmaya çalışmak, ufuk açmayı denemekten başka bir şey değildir.
