DEBATES OF OMBUDSMAN INSTITUTION IN THE TURKISH LEGISLATIVE BODY

Abstract

Ombudsman, which protects the rights of citizens in disputes between citizens and administrations, is a type of control and who lack sanction. It is not a stranger to Turkish public administration although its Swedish origin. However, in the modern sense of the institutions have not been able to replace the Turkish public administration until the end of the year. One of the important reasons is the presence of an ombudsman-like institutions and commission in the Turkish public control systems. The study reveals the perspectives of legislators to the ombudsman institutions and gives place to the debates in Turkish parliament debated the draft law in this context. The conclusions reached in the framework; the the deputies agreed that the institution is not foreign to Turkish public administration and control system but they disagreed on issues such as the status of the auditor, immunity, selection method whether the institution has sanction.

Özet

Ombudsmanlık, vatandaş ile idare arasındaki uyuşmazlıklarda vatandaşın hakkını koruyan, başvurması kolay ve yaptırımlardan yoksun olan bir denetim türüdür. Günümüzdeki anlamıyla İsveç’te ortaya çıkan ombudsmanlık Türk kamu yönetimi geleneğine yabancı olmayan bir kurumdur. Bununla beraber çağdaş anlamdaki kurumun Türk kamu yönetiminde yerini alması son yıllara kadar mümkün olmamıştır. Bunun önemli sebeplerinden birisi Türk kamu denetim sisteminde ombudsmanlık benzeri kurum ve komisyonların bulunmasıdır. Çalışma, kanun yapıcıların kamu denetçiliği kurumuna bakış açılarını ortaya koymakta ve bu çerçevede kanun tasarısı görüşülürken mecliste yapılan tartışmalara yer vermektedir. Çalışma çerçevesinde ulaşılan sonuç; milletvekillerinin kurumun Türk kamu yönetim ve denetim sistemine yabancı olmadığı konusunda hemfikir olmaları fakat kurumun ve denetçilerin statüsü, dokunulmazlıkları, seçim yöntemi, kurumun yaptırımının olup olmaması gibi konularında anlaşamamalarıdır.
