The legal ruling for sale by deposit

Abstract

One of the most popular financial transactions among people, whether in the past or nowadays, is the “Deposit”. This means that the buyer gives the seller a part of the price of the product or the deal, and if they proceed with the deal until the end, the buyer will pay the rest of the price. This way, the seller ensures that the buyer will continue with the payment, and buy the product or proceed with the deal. In case of cancelling the deal or not buying the product, the token payment stays with the seller, for that he (the seller) has not sold the product to another buyer, during his uncompleted transactions with the first one. In the same time, the buyer ensures that the seller will not sell the product to another buyer, because he has already paid him a part of its price. The buyer also knows that the deposit will not return to him in case he doesn’t end up buying the product. The buyer and the seller are both satisfied with this type of transaction, but is this legal in Islam? This is what we wanted to shed the light on in our research, for everything to become clear, and for our lives to be obeying Allah’s and the Prophet’s (PBUH) rules and guidelines.

Kaporalı satış, geçmişten bugüne insanlar arasında en yaygın finansal işlemlerden biridir. Yani alıcı satıcıya alışveriş işleminin tamamlanması hâlinde fiyatın geri kalan miktarın tamamını vermek üzere işlem değerinin bir kısmını önceden vermesidir. Eğer alışveriş tamamlanmazsa önceden verilen miktar satıcıda kalır. Böylelikle, satıcı müşterinin malı alıp ücreti tamamlamasını garanti altına almış olur ya da en azından satıcı, alıcının alışverişi tamamlamaktan çekilmesi durumunda malı başka müşteriye satmadan bekletmesine karşılık kaporayı alacağını garanti eder. Alıcı da kendisine bu fiyatın bir kısmını verdikten sonra satıcının bu malı başkasına satmayacağını garanti eder. Ayrıca alıcı, alışverişi tamamlamazsa bu depozitonun kendisine iade edilmeyeceğinin farkındadır. Satıcı ve alıcı bu gelenekten memnundur ve bu mes’elenin şer’î yönünden câizliği konusu çalışmamızın ve araştırmamızın odak noktasıdır. Allah'ın kanununa ve Resûlü'nün (S.A.V) Sünnetine göre yaşamımızın istikâmet üzere olması için bu tür satışların hükmüne ışık tutmak istedik.
